MOTION CARRIED 3. MINUTES a) June 10, 2010 .1J P -81/10 MOVED BY COUNCILLOR 3. HARBINSON that the minutes of the June 10, 2010 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS Councillor I. SCHROEDER - discussion of Development Permit process. 5. ADOPTION OF AGENDA P -82/10 MOVED BY COUNCILLOR M. DOUGLASS that the agenda be adopted as presented. MOTION CARRIED 6. BUSINESS FROM MINUTES a) Lathom Colony Farming LA10019A The Development Control Officer provided information regarding the NRCB request to relax monitoring requirements for the Lathom Colony Farming wastewater storage facility. The matter has been reviewed with the County Planner. During the discussion which followed, it was noted that there are no direct concerns which the County should have • regarding the proposal to relax the requirement for a water leakage monitor. The Development Control Officer confirmed this position would be communicated to the NRCB. 7. SUBDIVISIONS a) #2010 -0 -104 - Block 2, Lot 2 & 3, Plan 041 3476, NW 9- 19- 14 -W4M, Division 10 Howard Torkelson / Evergreen Implements Inc. (Owner) / (Applicant) To reconfigure portions of two existing lots, create 3 lots of various sizes for industrial use. The Development officer provided background information on the proposed subdivision. P -83/10 MOVED BY COUNCILLOR. HARBINSON that the Municipal Planning Commission APPROVE subdivision #2010 -0 -104, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant or owner or both enter into a Development Agreement with the County of Newell which shall be registered concurrently with the final plan against the title(s) being created. C/O Edwin Fosen (Owner) / (Applicant) To subdivide an existing 2.61 ha (6.45 acre) parcel for country residential use. The Development Officer provided background information on the proposed subdivision. There were no objections other than Alberta Transportation noting that they must meet section 14 subdivision regulations. P -84/10 MOVED BY COUNCILLOR B. DE.ONG that the Municipal Planning Commission APPROVE subdivision #2010 -0 -142, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant enters into an agreement with the County of Newell for the installation of any required road approaches to the proposed and /or remnant parcels. 3. That an easement agreement for mutual legal access between the two lots to allow shared access /egress to both lots, shall be provided before final approval of the subdivision. A copy of the signed easement agreement is required by the Subdivision Authority. 4. That the applicant submit to the Subdivision Authority a copy of a sketch from an Alberta Land Surveyor that certifies the location and dimensions of the existing buildings and the exact dimensions of the lot to be subdivided. The Development officer provided background information on the proposed subdivision. P -85/10 MOVED BY COUNCILLOR B. DEJONG that the Municipal Planning Commission APPROVE subdivision #2010 -0 -150, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant enters into an agreement with the County of Newell for the installation of any required road approaches to the proposed and /or remnant parcels. DEVELOPMENT PERMITS a) Permit #3397 - SW 32 -20 -14 -W4M, Lot 7, Block 30, Plan 091 1241 Division 8 David Wiens (Owner / Applicant) Installation of a moved -in dwelling with detached garage. The Development Control Officer provided background information on the proposed development permit. The purpose in the application is to obtain a permanent permit for a use which was previously approved on a temporary basis pending the registration of a plan of subdivision which is now complete. P -86/10 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning Commission APPROVE Development Permit #3397 for the installation of a moved -in dwelling with detached garage subject to the following conditions: This permit is being granted only for the installation of a moved -in dwelling with detached garage, on lands legally described as Lot 7, Block 30, Plan 091 1241, SW 32 -20 -14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) All Federal, Provincial and Municipal statutes, regulations, codes and standards. b) The provisions of Land Use Bylaw #1626 -07, and amendments • thereto, pertaining to the Country Residential District. c) All Alberta Building Codes where applicable. If the developer is required to obtain a building permit, it is his / her responsibility to do so, and furthermore, this permit must be obtained from an accredited inspection agency. d) Any other required permits, including electrical, heating & ventilation, gas and /or plumbing. All permits must be obtained from an accredited inspection agency. Subject to the following conditions: e) That this development is located as shown on the site plan approved in this application and submitted May 31, 2010. Any changes to that plan shall require the written approval from the Development Officer. f) That the following setbacks on all sides are maintained for this development: Front (north): 20 ft (6.1 m) Side (east and west): 5 ft (1.5 m) Rear (south): 20 ft (6.1 m) g) That accessory building is not closer than 2 ft (0.6 m) from a side or rear lot line; overhanging eaves are not closer than 1 ft (0.3 m) from a side lot line. h) That there is a 2 m (6.6 ft.) separation distance between the dwelling and the detached garage, and any other proposed or existing buildings. i) That the proposed accessory building is not used for living purposes. j) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. • June 24, 2010 Municipal Planning Commission Page 4 k) That any residence and /or structures are located a minimum distance of 100 m (328 ft) from any gas or oil well on or adjacent to the property. A variance of this distance may only be provided by the ECRB. MOTION CARRIED c) Permit #3425 - SE 18 -19 -14 W4M, Lot 1, Block 3, Plan 081 4799, Division 10 Alan Reesor (Owner) / (Applicant) Greenhouse Operation The Development Control Officer provided background information on the proposed development permit. A concept plan has been prepared and reviewed by the County Planner, Development Officer and Landowner to look at what could realistically be carried out over the next 3 years. There was concern from Council regarding fire hazards and previous burning without permits. It was noted that the County's Fire and Emergency Services Coordinator has met with landowner to discuss proper permits and prevention. The Development Control Officer will be working with the landowner to make sure all conditions are met. P -87/10 MOVED BY COUNCILLOR H. WUTZKE that the Municipal Planning Commission APPROVE Development Permit #3425, for a Greenhouse Operation subject to the following conditions: This permit is being granted only for compliance of the existing greenhouse operation and further development of the business, on lands legally described as Lot 1, Block 1, Plan 081 4799, SW 18 -19 -14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Commercial District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626 -07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes, where applicable. If the developer is required to obtain a building permit, it is his / her responsibility to do so, and furthermore, this permit must be obtained from an accredited inspection agency. d) All Alberta Safety Codes, where applicable. If the developer is installing a new sewage disposal system, he /she is required obtain a Private Sewage Disposal System Permit, issued by a licensed, accredited inspection agency. e) Any other required permits, including electrical, heating & ventilation, gas and /or plumbing. All permits must be issued by a licensed agency. Subject to the following conditions: f) That this development is located as shown on the site plan approved in this application and submitted June 4, 2010. Any changes to that plan shall require the written approval of the Development Officer. June 24, 2010 Municipal Planning Commission Page 5 g) That the developer obtains a Roadside Development Permit from Alberta Transportation. A copy of this permit must be submitted to the Development Officer. h) That the developer obtains a Sign Installation Permit from Alberta Transportation in order to install a sign(s) advertising the business on Highway #1. A copy of this permit must be submitted to the Development Officer. i) That the following setbacks are maintained for this development: Front (Joanne Trucking Road): 20 ft (6 m) Side (east and west): 10 ft (3 m) Rear (Hwy #1): as required by AB Transportation j) That there is a 2 m (6.6 ft.) separation distance between all Atco Trailers that are not attached, between greenhouses that are not attached, between all other accessory buildings not specifically stated here, and between the dwelling and any other building on the site. k) That the exterior of the Atco Trailers and Sales Office shall be sided with similar materials that are consistent and uniform in color. I) That the Atco Trailers and any other accessory buildings on the parcel shall not be used for living purposes, temporary or otherwise. m) That provision is made on the property to allow year round all weather access for firefighting purposes. In this regard, miscellaneous debris and items deemed useful by the applicant must be stored in the Atco Trailers and grass must be kept cut. n) That the following items are to be included in this development permit, as shown on the Concept Plan attached with this permit: 1. Improvements to the existing Atco Trailers (A -1 to A -7), including but not limited to re- siding the trailers, re- roofing the trailers, and making sure there is proper spacing between trailers. The arrangement of the trailers is as indicated on the Concept Plan. Final placement is subject to approval by the County Development Officer. 2. Storage within the trailers may include but is not limited to the following: production and storage of dried flowers for wholesale and retail sales, storage of firewood for wholesale and retail sales, and storage of ancillary garden center / greenhouse operation items. 3. Improvements to the existing Sales Office (B), including but not limited to re- siding and re- roofing the structure. 4. Development of a designated parking area (C), to be levelled and gravelled in such a way as to facilitate customer access and egress. 5. Operation of the existing 11x14 greenhouse display area (D); this permit is also approval for the addition of a 2 display area of the same size connected to the existing display area. 6. There are 3 existing greenhouses on the site. These greenhouses will be removed from their present location and rebuilt as indicated (E) on the Concept Plan. o) That the Atco Trailers are being approved under this permit as accessory buildings, to be used for storage of items intrinsic to the operation of the greenhouse business. They shall not be used as dwellings, temporary or otherwise. p) Any development beyond the 3 -year time period shall become part of a new development permit. In addition, any development not included in the Concept Plan and specifically stated by this permit shall require a separate development permit. q) The following items are not included in this development permit: 1. Construction of a coffee shop, or any other type of eating establishment. June 24, 2010 Municipal Planning Commission Page 6 2. Additional greenhouse buildings, either new or additions to existing buildings; any additional buildings shall require individual permit approval. 3. Additional accessory buildings, including but not limited to Atco Trailers, sheds, garages or any other building /structure; any additional accessory buildings shall require additional permit approval. 4. Anything not listed in (f) of this development permit. r) That all parking and maneuvering areas be leveled and dust - proofed using pavement or crushed rock /gravel. MOTION CARRIED 9. POST AGENDA Councillor I. SCHROEDER commented that questions had been brought to his attention regarding the process for placing a mobile home on a parcel of land. After reviewing the development approval requirements for mobile homes, he felt the current approval process requirements to provide pictures of the home was not working for developers who may want to install services before purchasing a specific mobile home. The Development Control Officer stated that according to the Land Use Bylaw we need to see pictures so that if the mobile needs improvements it can be put on the permit conditions. She will review that aspect of the process during a review of the Land Use Bylaw. Arrived at Meeting 10:27 a.m. \r✓ Mike McDonald, Schlumberger Karl Groot, Schlumberger 8. DEVELOPMENT PERMITS — CONTINUED b) Permit #3398 - SE 30 -18 -14 W4M, Division 5 Cliff Sewall (Owner) / Schlumberger (Applicant) Installation of an Explosives Magazine (container) The Development Control Officer provided background information on the proposed development permit. Representatives from Schlumberger gave MPC a hand out and went over the reasons for Explosives Magazines as well as how the explosives are used in the oil industry. It was noted that these explosives can only be detonated by a primary explosive that is kept in another area. It was also mentioned that there is excessive security measures and that they have to be approved by the Federal Government. Arrived at Meeting 10:33 M. Fitzgerald, Q -13 Fox Radio Councillor M. Douglass left at 10:38 and returned at 10:40 Arrived at Meeting 10:43 a.m. Councillor R. ANDREWS Schlumberger then requested to withdraw the permit application stating that they will be reapplying for another location. Their purpose in June 24, 2010 Municipal Planning Commission Page 7 attending the meeting was to provide information regarding these facilities in advance of a new application being submitted. It was suggested by MPC that they provide the same presentation for the IMDP committee. CIO 10. IN CAMERA ITEMS There were no in camera items. 11. QUESTION PERIOD None 12.
