CALL TO ORDER The Chairman called the meeting to order at 10:02 a.m. 2. EXCUSED FROM MEETING P -88/10 MOVED BY COUNCILLOR I. SCHROEDER that Councillor A. Eastman be excused from the meeting. MOTION CARRIED 3. MINUTES a) June 24, 2010 X,\ P -89/10 MOVED BY COUNCILLOR H. WUTZKE that the minutes of the June 24, 2010 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P -90/10 MOVED BY COUNCILLOR R. ANDREWS that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT JUNE 1 — JUNE 30, 2010 The Development Control Officer reviewed a summary of Permitted Use permits issued. P -91/10 MOVED BY COUNCILLOR M. DOUGLASS that the development report be adopted as presented. • MOTION CARRIED 7. DEVELOPMENT PERMITS a) Permit #3430- Plan 851 0570, Block B, NE 1- 20 -13- W4M, Division 3 Cory Johnston (Owner / Applicant) Addition to existing accessory building, with variances to front yard and side yard setback requirements; compliance for existing accessory building. The Development Control Officer provided background information on the proposed development permit. It was noted that at the time of subdivision (1985), building setback requirements were not in place. P -92/10 MOVED BY COUNCILLOR J. HARBINSON that the Municipal Planning Commission APPROVE Development Permit #3430 for the addition to an existing accessory building with variance and compliance for existing accessory building subject to the following conditions: This permit is being granted only for the construction of a 672 ft (62 m addition to an accessory building (garage), and compliance for the existing 672 ft (62 m accessory building, with variances to the front yard and side yard setback requirements, on lands legally described as Block B, Plan 851 0570, NE 1 -20 -13 W4M. Any additional development t shall require prior approval of a separate permit application. July 8, 2010 Municipal Planning Commission Page 2 The proposed development complying with: a) All Federal, Provincial and Municipal statutes, regulations, codes and standards. b) The provisions of Land Use Bylaw #1626 -07, and amendments thereto, pertaining to the Country Residential District. c) All Alberta Building Codes where applicable. If the developer is required to obtain a building permit, it is his / her responsibility to do so, and furthermore, this permit must be obtained from an accredited inspection agency. d) Any other required permits, including electrical, heating & ventilation, gas and /or plumbing. All permits must be obtained from an accredited inspection agency. Subject to the following conditions e) That this development is located as shown on the site plan approved in this application and submitted June 18, 2010. Any changes to that plan shall require the written approval from the Development Officer. f) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. g) That the following setbacks are maintained for this development: Front (south):82 ft (25 m) Side (east): 3 ft (1 m) Rear (north): 20 ft (6.1 m) h) That there is a 2 m (6.6 ft.) separation distance between the new building and other buildings. i) That the exterior of the proposed addition is sided with materials the same as, or consistent with, the exterior of the existing building. j) That the accessory building that results from the combination of the existing garage and the proposed addition is not used for living purposes. k) That any residence and /or structures are located a minimum distance of 100 m (328 ft) from any gas or oil well on or adjacent to the property. A variance of this distance may only be provided by the ECRB. I) Development Notification: the developer shall notify the Development Officer: i. prior to the commencement of actual development thereon, and ii.upon completion of the development MOTION CARRIED 8. OTHER BUSINESS a) Vulcan County Land Use Bylaw The County Planner reviewed the Vulcan County Land Use Bylaw, noting that the updated County of Newell Land Use Bylaw will be similar to the Vulcan County Bylaw. She provided highlights from the Vulcan County bylaw that will be pertinent to the updated County of Newell bylaw, such as subdividing smaller parcels, updated definitions, and policy for second dwellings. Further discussion followed regarding communal septic systems and that consideration is given to this type of system when preparing the updated land use bylaw.
