MUNICIPAL PLANNING COMMISSION MEETING
September 9, 2010
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, AB on Thursday, September 9, 2010 commencing
at 9:59 a.m.

The Chairman called the meeting to order at 9:59 a.m.

5, 2010 Municipal Planning Commission meeting be adopted as presented.

6. DEVELOPMENT REPORT - _JULY 1, 2010 - AUGUST 31, 2010
The Chairman questioned the cost of the Accessory building in Development
permit 3437. The County Planner explained that the landowner has a
welding business and that the accessory building would be used for a
welding shop.

To subdivide a previously subdivided quarter section to create one new
parcel for country residential use.
The County Planner provided background information on the proposed
subdivision. It was noted by the County Planner that the property was
recently rezoned and a dwelling will be constructed in the future and
that Municipal Reserve is required for this application.

parcel which is proposed to be consolidated with the adjacent quarter
section to the east.
The County Planner provided background information on the proposed
subdivision.

Commission APPROVE subdivision #2010 -0 -188, subject to the following
conditions:
1. That all outstanding property taxes shall be paid to the County of
Newell.
2. That the subdivided portion of Lot 4, Block 2, Plan 021 1860 be
consolidated with the adjacent parcel legally known as the NE 23 -16 -4
in a manner such that the resulting Certificate of Title could not be
subdivided without the approval of the Subdivision Authority.

The County Planner provided background information on the proposed
subdivision.

Commission APPROVE subdivision #2010 -0 -207, subject to the following
conditions:
1. That all outstanding property taxes shall be paid to the County of
Newell.
2. That the applicant or owner or both enter into a Development
Agreement with the County of Newell which shall be registered
concurrently with the final plan against the title(s) being created.

To reconfigure 2 existing titled parcels to create 5 new lots of various
sizes.
The County Planner provided background information on the proposed
subdivision. Further discussion followed regarding whether drainage
was an issue for the subdivision.

Commission APPROVE subdivision #2010 -0 -208, subject to the following
conditions:
1. That all outstanding property taxes shall be paid to the County of
Newell.

2. That the applicant or owner or both enter into a Development
Agreement with the County of Newell which shall be registered

3. That the applicant submit to the Subdivision Authority a copy of a sketch
from an Alberta Land Surveyor that certifies the location and dimensions
of the existing buildings and the exact dimensions of the lot to be
subdivided.
4. That the easement(s) as required by FORTISALBERTA or any other
utility agency or the municipality shall be established prior to finalization
of the application and are to be registered simultaneously with the legal
plan of the subdivision.
5. That the existing encumbrance for a home owners association be
amended to include the newly created Tots.

The County Planner provided background information on the proposed
subdivision.
P- 111/10 MOVED BY COUNCILLOR I. SCHROEDER that the Municipal Planning
Commission APPROVE subdivision #2010 -0 -209, subject to the following
conditions:
1. That all outstanding property taxes shall be paid to the County of
Newell.
2. That the applicant submit to the Subdivision Authority a copy of a sketch
from an Alberta Land Surveyor that certifies the location and dimensions

8. DEVELOPMENT PERMITS
a) Permit #3450 - NE 35 -14 -14 -W4M, Lot 1, Block 1, Plan 081 0038,
Division 1
Cornelio Schmit (Owner) / (Applicant)
Installation of a manufactured home, with an addition and attached
garage.
The Development Control Officer provided background information on
the proposed development permit. She indicated that, since the
applicant intends to completely renovate the interior and exterior of
the manufactured home, the age of the home should not be an issue
for approval by MPC. Cenovus submitted a letter indicating concern

about the placement of the structure on the property since they have
several pipelines crossing it; they will work with the applicant when
construction commences. An adjacent landowner submitted a letter
indicating concern regarding standards of construction; these issues
are covered in the development permit. Further discussion followed
regarding ensuring that all proposed improvements to the dwelling
would be completed. The Development Control Officer stated that a
security deposit could be a condition of approval and noted that the
construction would be inspected by an accredited building inspector
during and after renovation. Council indicated that a $2500 security
deposit be included with the conditions on the permit to ensure the
indicated renovations are completed.
P- 112/10 MOVED BY COUNCILLOR A. EASTMAN that the Municipal Planning
Commission APPROVE Development Permit #3450 and grant approval
for the installation of a manufactured home with an addition and
attached garage subject to the following conditions:
That the Municipal Planning Commission APPROVE Development Permit
#3450 and grant approval for the installation of a 1976 manufactured
dwelling with an addition and an attached garage, subject to the
following conditions:
This permit is being granted only for the installation of 1008 ft (93.6
m 1976 manufactured home with a 720 ft (66.9 m addition and a
384 ft (35.7 m attached garage, on lands legally described as Lot 1,
Block 1, Plan 081 0038, NE 35 -14 -14 W4M. Any additional development
shall require prior approval of a separate permit application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b) The provisions of Land Use Bylaw #1626 -07, and amendments
thereto, pertaining to the Country Residential District.
c) All Alberta Building Codes where applicable. If the developer is
required to obtain a building permit, it is his / her responsibility to
do so, and furthermore, this permit must be obtained from an
accredited inspection agency.
d) Any other required permits, including electrical, heating &
ventilation, gas and /or plumbing. All permits must be obtained from
an accredited inspection agency.
Subject to the following conditions
e) That this development is located as shown on the site plan approved
in this application and submitted June 18, 2010. Any changes to that
plan shall require the written approval from the Development
Officer.
f) That the developer provide the County of Newell with a security
deposit, in the amount of $2500.00 to ensure that the requirements
of the following conditions are met:
i) the development is completed as specified in this permit
and application, including replacement of windows, siding
and roof of the manufactured dwelling, within two years
from the date of approval.
g) That the property is not used for conducting a business or
commercial operation without first obtaining the required permits.
h) That the following setbacks are maintained for this development:

Front (north): 100 ft (30 m)
Side (east and west): 20 ft (6 m)
Rear (south): 20 ft (6 m)
i) That the exterior of the manufactured home, addition, and attached
garage are all sided with consistent and complementary materials.
i) That any residence and /or structures are located a minimum
distance of 100 m (328 ft) from any gas or oil well on or adjacent to
the property. A variance of this distance may only be provided by
the ECRB.
j) The developer must start construction before September 21, 2011
and be completed by September 21, 2012. In the event that either
of these dates are not met, the developer may be required to apply
for a new permit.
k) Development Notification: the developer shall notify the
Development Officer:
I. prior to the commencement of actual development
thereon, and
II. upon completion of the development

b) Permit #3446 - NW 7 -19 -14 W4M, Lot 7, Block 2, Plan 911 1302,
Division 4

Construction of an addition to an existing shop; variance to side yard
setback.
The Development Control Officer provided background information on
the proposed development permit. She indicated that, in order to bring
the existing shop into compliance, a side yard setback variance is also
required for this permit.
P- 113/10 MOVED BY COUNCILLOR H. WUTZKE that the Municipal Planning
Commission APPROVE Development Permit #3446, and grant approval
for the construction of an addition to an existing shop with a variance to
side yard setback subject to the following conditions
This permit is being granted only for the construction of a 504 ft (46.8
m addition to the existing shop, on lands legally described as Lot 7,
Block 2, Plan 911 1302, NW 7 -19 -14 W4M. Any additional development
shall require prior approval of a separate permit application.
a) The provisions pertaining to the Industrial District and all relevant
schedules, as outlined in the County of Newell Land Use Bylaw
# 1626 -07.
b) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
c) All Alberta Building Codes, where applicable. If the developer is
required to obtain a building permit, it is his / her responsibility to
do so, and furthermore, this permit must be obtained from an
accredited inspection agency.
d) All Alberta Safety Codes, where applicable. If the developer is
installing a new sewage disposal system, he /she is required obtain
a Private Sewage Disposal System Permit, issued by a licensed,
accredited inspection agency.

e) Any other required permits, including electrical, heating &
ventilation, gas and /or plumbing. All permits must be issued by a
licensed agency.
Subject to the following conditions
f) That this development is located as shown on the site plan approved
in this application and submitted July 19, 2010. Any changes to that
plan shall require the written approval of the Development Officer.
g) That the exterior of the proposed addition is sided with materials the
same as, or consistent with, the exterior of the existing building.
h) That neither the shop nor the addition is used for living purposes.
i) The developer must start construction before September 21, 2011
and be completed by September 21, 2012. In the event that either
of these dates are not met, the developer may be required to apply
for a new permit.
j) That access can be provided for Emergency Services vehicles to all
sides of the building.
k) That the following setbacks on all sides are maintained for this
development:
Front (north): n/a
Side (east): 3 ft (1 m)
Rear (south): 20 ft (6 m)
