Douglass, Councillor J. Bulger, Councillor M. Nesbitt, Councillor C. Amulung, Councillor A. Eastman, Councillor B. de Jong, Councillor L. Juss, Councillor A.M. Philipsen, Councillor I. Schroeder, Councillor R. Andrews, Councillor STAFF: K. Stephenson, CAO L. Johnson, Assistant Administrator D. Horvath, Planner - ORRSC A. Wickert, Development Control Officer S. CALL TO ORDER The Assistant Administrator called the meeting to order at 12:53 p.m. 2. ELECTION OF MPC CHAIR & VICE CHAIR As Secretary for the MPC, the Assistant Administrator called for nominations for M.P.C. Chair. Councillor M. DOUGLASS nominated Councillor A.M. PHILIPSEN The Assistant Administrator called a second and third time for nominations. No further nominations were received. L. Johnson declared Councillor A.M. PHILIPSEN Chair for the M.P.C. Councillor A.M. PHILIPSEN called for nominations for M.P.C. Vice Chair. Councillor I. SCHROEDER nominated Councillor A. EASTMAN Councillor A.M. PHILIPSEN called a second and third time for nominations for M.P.C. Vice Chair. No further nominations were received. Councillor A.M. PHILIPSEN declared Councillor A. EASTMAN Vice Chair for M.P.C. 3. EXCUSED FROM MEETING All members were present. 4. MINUTES a) October 7, 2010 P- 138/10 MOVED BY COUNCILLOR A. EASTMAN that the minutes of the October 7, 2010 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 5. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 6. ADOPTION OF AGENDA • P- 139/10 MOVED BY COUNCILLOR B. DEJONG that the agenda be adopted as presented. MOTION CARRIED 7. DEVELOPMENT PERMITS a) Permit #3474 - Lot 1, Block 19, Plan 041 3384, NE 1 -21 -16 W4M, Division 7 Gilbert Mayan (Owner ) / ( Applicant) Construction of an accessory building; compliance for existing dwelling and 3 accessory buildings; variance to front yard setback requirement. The Development Control Officer provided background information regarding the proposed development permit. A permit from Alberta Transportation is required but to date has not been received, this will be added as a condition. P- 140/10 MOVED BY COUNCILLOR A. EASTMAN that the Municipal Planning Commission APPROVE Development Permit #3474 for construction of an accessory building; compliance for an existing dwelling and 3 accessory buildings and variance to front yard setback requirement subject to the following conditions: CP October 21, 2010 Municipal Planning Commission Page 2 This permit is being granted only for the construction of a 2240 ft (208 m shop, compliance for an existing 1206 ft (112 m dwelling, with variance to the front yard setback, and compliance for a 562 ft (52.2 m barn, a 220 ft (20 m accessory building (shed), and a 157 ft (14.6 m accessory building (shed), on lands legally described as Lot 1, Block 19, Plan 041 3384, NE 1 -21 -16 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Small Holding District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626 -07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes, where applicable. If the developer is required to obtain a building permit, it is his / her responsibility to do so, and furthermore, this permit must be obtained from an accredited inspection agency. d) All Alberta Safety Codes, where applicable. If the developer is installing a new sewage disposal system, he /she is required to obtain a Private Sewage Disposal System Permit, issued by a licensed, accredited inspection agency. e) Any other required permits, including electrical, heating & ventilation, gas and /or plumbing. All permits must be issued by a licensed agency. Subject to the following conditions f) That this development is located as shown on the site plan approved in this application and submitted October 1, 2010. Any changes to that plan shall require the written approval of the Development Officer. g) That the developer obtain a Roadside Development Permit from Alberta Transportation. A copy of the permit must be submitted to the Development Officer. That there is a 2 m (6.6 ft.) separation distance between the new building and any proposed accessory buildings. h) That there is a 2 m (6.6 ft.) separation distance between the new building and any proposed accessory buildings. i) The developer must start construction before November 2, 2011 and be completed by November 2, 2012. In the event that either of these dates cannot be met, the developer may be required to apply for a new permit. g) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. h) That no accessory buildings on the parcel are used for living purposes.
