MUNICIPAL PLANNING COMMISSION MEETING
February 24, 2011
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, AB on Thursday, February 24, 2011 commencing
at 10:00 a.m.

7. SUBDIVISIONS
a) #2011 -0 -009 - NE 5 -18 -14 -W4M, Division 5
E.I.D (Owner) / (Applicant)
To reconfigure 3 existing agriculture titles to create three new parcels of
various sizes by subdividing and consolidating titles within the NE 5-18 -
14 -W4M.
The County Planner provided background information on the proposed
subdivision. The reason for the subdivision is to eliminate one title and
make the parcel larger. Since there is only going to be a change in title,
there is no rezoning required. ERCB replied that there are wells in the
area but there is room for construction. Alberta Transportation would
like one access and requires a service road. There was one adjacent
landowner response stating that he felt there were too many
subdivisions in the area.
P -14/11 MOVED BY COUNCILLOR B. DE.ONG that the Municipal Planning
Commission APPROVE subdivision #2011 -0 -009, subject to the following
conditions:
1. That all outstanding property taxes shall be paid to the County of
Newell.
2. That the applicant or owner submit to the Subdivision Authority a copy
of a sketch from an Alberta Land Surveyor that certifies the location and
dimensions of the existing buildings and the exact dimensions of the lot
to be subdivided.
3. That a 30 -metre wide service road shall be dedicated by caveat located
perpendicular and across the highway frontage of the parcels to be

created to comply with section 15(2) of the Subdivision and
Development Regulation.

b) #2011 -0 -019 - E 17 -19 -13 -W4M, Division 10
Jason & Kersten Mortensen (Owner) / (Applicant)
To create one new parcel containing an existing farmstead from a titled
area of 136.0 acres (55.0 ha) for Country Residential use.
The County Planner provided background information on the proposed
subdivision. The applicant would like to subdivide out the small
farmyard and has been requested by the County to consolidate the two
agriculture pieces to solve the issue of access. Questions were raised
regarding municipal reserve. The County Planner responded that the
previously subdivided areas of the quarter were subdivided by the EID
or County and not the applicant, therefore it would be the first
subdivision out by the landowner for Municipal reserve purposes.
P -15/11 MOVED BY COUNCILLOR I. SCHROEDER that the Municipal Planning
Commission APPROVE subdivision #2011 -0 -009, subject to the following
conditions:
1. That all outstanding property taxes shall be paid to the County of
Newell.
2. That the applicant or owner submit to the Subdivision Authority a copy
of a sketch from an Alberta Land Surveyor that certifies the location and
dimensions of the existing buildings and the exact dimensions of the lot
to be subdivided.
3. That the residual portion of SE 17 -19 -13 W4M be consolidated with the
adjacent parcel legally known as NE 17 -19 -13 W4M in a manner such
that the resulting Certificate of Title could not be subdivided without the
approval of the Subdivision Authority.

8. AGRICULTURE SUPPORT SERVICE & HOME OCCUPATION PERMITS
a) HO 175 - RENEWAL - Lot 1, Block 1, Plan 951 2595, SW 9 -19 -14
W4M, Division 10

Renewal of existing permit for a general contracting business.
The Development Control Officer provided background information on
the proposed development permit. It was noted that this is the third
renewal request and it is for a permanent permit. This permit was
reviewed by the IMDP and was approved with the following conditions.
P -16/11 MOVED BY COUNCILLOR A. EASTMAN that the Municipal Planning
Commission APPROVE Home Occupation Permit #175 and grant
approval for an existing general contracting business subject to the
following conditions: ffaA

This permit is being granted only for the operation of a general
contracting construction business, on lands legally described as Lot 1,
Block 1, Plan 951 2595, SW 9 -19 -14 W4M. Any additional development
shall require prior approval of a separate permit application.
a) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b) The provisions of Land Use Bylaw #1626 -07, and amendments
thereto, pertaining to the Brooks Urban Fringe District.
c) All Alberta Building Codes where applicable. If the developer is
required to obtain a building permit, it is his / her responsibility to
do so, and furthermore, this permit must be obtained from an
accredited inspection agency.
d) Any other required permits, including electrical, heating &
ventilation, gas and /or plumbing. All permits must be obtained from
an accredited inspection agency.
Subject to the following conditions
e) That this development is located as shown on the site plan approved
in this application and submitted January 12, 2011. Any changes to
that plan shall require the written approval from the Development
Officer.
f) That there are no more than 2 resident employees involved in the
operation of this business.
g) That the following vehicles are permitted to be used in conjunction
with the Home Occupation Permit: 1 - 1 /2 ton truck, 3 cargo vans, 1
- 18 ft flatdeck trailer, and 1 - 14 ft dump trailer. No other
commercial vehicles shall be permitted.
h) 1 - 4 ft x 8 ft sign is permitted to advertise the business.
