Douglass, Councillor C. Amulung, Councillor M. Nesbitt, Councillor L. Juss, Councillor A. Eastman, Councillor B. de Jong, Councillor J. Bulger, Councillor A.M. Philipsen, Councillor & M.P.C. Chair I. Schroeder, Councillor R. Andrews, Councillor ABSENT: None STAFF: K. Stephenson, CAO L. Johnson, Assistant Administrator D. Horvath, Planner - ORRSC A. Wickert, Development Control Officer S. Simpson, Development Control Clerk OTHERS IN ATTENDANCE: Sandra Stanway, Brooks Bulletin 1. CALL TO ORDER The Chairman called the meeting to order at 10:02 a.m. 2. EXCUSED FROM MEETING All members were present. 3. MINUTES a) February 24, 2011 x, P -17/11 MOVED BY COUNCILLOR B. DEJONG that the minutes of the February 24, 2011 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P -18/11 MOVED BY COUNCILLOR A. EASTMAN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT FEBRUARY 1 -28, 2011 The Development Control Officer presented the Development report and noted that the McCulloch Permit has been changed to discretionary and will be on the next MPC meeting. P -19/11 MOVED BY COUNCILLOR M. DOUGLASS that the Development Report be adopted as presented. MOTION CARRIED 7. SUBDIVISIONS a) #2011 -0 -032 - NE 19- 15- 13 -W4M Vern Parker (Owner) / (Applicant) To create one new parcel containing an existing farmstead from a titled area of 47.88 acres (19.3 ha) for Country Residential use. The County Planner provided background information on the proposed subdivision. It was noted that there was an error on the map that was circulated and it has since been corrected. There is a deferred reserve caveat from a previous subdivision that will be one of the conditions of this approval. Alberta Transportation responded that the applicant can keep the same access. There was concern from members of MPC regarding access to the residual parcel. The County Planner responded that there is an undeveloped road allowance and we could request an access easement agreement. It was questioned by MPC if it would be the responsibility of the prospective buyer to construct a road within the road allowance and if those details are buyer beware. The County Planner responded that it would be up to the buyer to construct the road. It may be possible to register that requirement in the form of a development agreement against the title of the residual parcel. Arrived at meeting Councillor ). EASTMAN that the Municipal Planning Commission APPROVE subdivision #2011 -0 -032, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant submit to the Subdivision Authority a copy of a sketch from an Alberta Land Surveyor that certifies the location and dimensions of the existing buildings and the exact dimensions of the lot to be subdivided. MOTION CARRIED 8. POST AGENDA 9. IN CAMERA ITEMS There were no in camera items. 10. OUESTION PERIOD None 11.
