CALL TO ORDER The Chairman called the meeting to order at 10:03 a.m. 2. EXCUSED FROM MEETING All members were present. 3. MINUTES a) March 10, 2011 I \ P -21/11 MOVED BY COUNCILLOR M. NESBITT that the minutes of the March 10, 2011 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P -22/11 MOVED BY COUNCILLOR A. EASTMAN that the agenda be adopted as presented. MOTION CARRIED 6. SUBDIVISIONS a) #2011 -0 -040 - 30- 20- 15 -W4M, Parcel A, Plan 5227FD, Division 7 Lammert & Elisabeth Lyzenga (Owner) / (Applicant) To subdivide an approximate 87.18 acre (35.28 ha) portion of an existing 231.95 acre (93.58 ha) title. The County Planner provided background information on the proposed subdivision. The parcel flows across the entire section and the applicant would like to subdivide part of the parcel along the quarter section line. The parcel is consolidated so a subdivision is required as opposed to changing it through land titles. M.P.C. questioned if there was water to the parcel, the County Planner responded that the concern of water would be dealt with at the Development stage. P -23/11 MOVED BY COUNCILLOR A. EASTMAN that the Municipal Planning Commission APPROVE subdivision #2011 -0 -040, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant enters into an agreement with the County of Newell for the installation of any required road approaches to the proposed or remnant parcels. MOTION CARRIED 7. DEVELOPMENT PERMITS a) Permit #3491 - NE 13 -20 -13 W4M, Lot 2, Block 15, Plan 791 0924, Division 3 Robert McCulloch (Owner) / (Applicant) Installation of a manufactured dwelling The Development Control Officer provided background information on the proposed development permit. March 24, 2011 Municipal Planning Commission Page 2 P -24/11 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning Commission APPROVE Development Permit #3491 and grant approval for installation of a manufactured dwelling subject to the following conditions: This permit is being granted only for the installation of a 1520 ft (141.2 m manufactured dwelling, on lands legally described as Lot 2, Block 15, Plan 791 0924, NE 13 -20 -13 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) All Federal, Provincial and Municipal statutes, regulations, codes and standards. b) The provisions of Land Use Bylaw #1626 -07, and amendments thereto, pertaining to the Country Residential District. c) All Alberta Building Codes where applicable. If the developer is required to obtain a building permit, it is his / her responsibility to do so, and furthermore, this permit must be obtained from an accredited inspection agency. d) Any other required permits, including electrical, heating & ventilation, gas and /or plumbing. All permits must be obtained from an accredited inspection agency. Reasons for Approval The Municipal Planning Commission has approved DP #3487 for the following reasons: 1. The proposed development complies with both the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed 4 .110. development is suitable for the purpose for which it is intended under the Hamlet Residential District (Schedule 2), Standards of Development (Schedule 4) and Development Standards for Mobile Homes within Hamlets (Schedule 8), as specified in the County of Newell Land Use Bylaw #1626 -07. 3. As no objections have been received from adjacent landowners or referral agencies with respect to the proposed development, the Development Authority has granted an approval. Subject to the following conditions e) That this development is located as shown on the site plan approved in this application and submitted February 15, 2011. Any changes to that plan shall require the written approval from the Development Officer. f) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. g) That the following setbacks are maintained for this development: Front (west):20 ft (6.1 m) Side (north): 5 ft (4 m) Side (south):20 ft (6.1 m) h) That there is a 2 m (6.6 ft.) separation distance between the new building and other buildings. i) The developer must start construction before March 24, 2012 and be completed by March 24, 2013. Bulger 10:14 a.m. b) Permit #3493 - NE 31 -15 -13 W4M, Lot 1, Block 1, Plan 981 1171, Division 1 Oasis Trailer Manufacturing (Owner) / Aron Giesbrecht (Applicant) Addition to existing shops The Development Control Officer provided background information on the proposed development permit. The applicant would like to construct an addition connecting his welding and paint shop. Two letters were received from adjacent landowners regarding fire issues and road access. H. Johnson, an adjacent landowner stated that she had concerns because of two previous fires at the welding shop and that the applicant shares an access with them and she wants a fence to be constructed between the properties. The response from the County's Fire and Emergency Services Coordinator is that a fire can come from any direction and suggested that the adjacent landowner put up a fire guard around his pump house. M.P.C. agreed that a fence should be one of the conditions on the permit and that the applicant have till August 31, 2011 to construct the fence to appropriate standards. P -25/11 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning Commission APPROVE Development Permit #3493, and grant approval for the addition to existing shops, and subject to the following conditions: or This permit is being granted only for the construction of an 8000 ft (742.2 m shop addition, on lands legally described as Lot 1, Block 1, Plan 981 1171, NE 31 -15 -13 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Commercial District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes, where applicable. If the developer is required to obtain a building permit, it is his / her responsibility to do so, and furthermore, this permit must be obtained from an accredited inspection agency. d) All Alberta Safety Codes, where applicable. If the developer is installing a new sewage disposal system, he /she is required obtain a Private Sewage Disposal System Permit, issued by a licensed, accredited inspection agency. e) Any other required permits, including electrical, heating & ventilation, gas and /or plumbing. All permits must be issued by a licensed agency. Reasons for Approval The Municipal Planning Commission has approved DP #3493 for the following reasons: 1. The proposed development complies with both the Municipal Development Plan and Land Use Bylaw #1626 -07. March 24, 2011 Municipal Planning Commission , � Page 4 sk 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Commercial District (Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw #1626-07. 3. The Development Authority has placed specific conditions on the approval which will mitigate issues identified through the referral process. Subject to the following conditions f) That this development is located as shown on the site plan approved in this application and submitted March 3, 2011. Any changes to that plan shall require the written approval of the Development Officer. g) That the developer obtains a Roadside Development Permit from Alberta Transportation. A copy of this permit must be submitted to the Development Officer. h) That the addition and other shop buildings are not used for living purposes. i) The developer must construct a new 4 wire barb wire fence along the southern boundary of his parcel, so that further use of the existing road is eliminated. j) The developer must start construction before March 24, 2012 and be completed by March 24, 2013. In the event that either of these dates are not met, the developer may be required to apply for a new permit. MOTION CARRIED 8. POST AGENDA 9. IN CAMERA ITEMS There were no in camera items. 10.
