EXCUSED FROM MEETING P -35/11 MOVED BY COUNCILLOR M. NESBITT that Councillor R. Andrews be excused from the meeting. MOTION CARRIED 3. MINUTES a) April 21, 2011 0 P -36/11 MOVED BY COUNCILLOR B. DEJONG that the minutes of the April 21, 2011 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. LATHOM SCHOOL SIGN SITE 5. ADOPTION OF AGENDA P -37/11 MOVED BY COUNCILLOR A. EASTMAN that the agenda be adopted as amended. MOTION CARRIED 6. DEVELOPMENT REPORT APRIL 1 -30, 2011 It was noted by the Manager of Planning and Development that as a result of the zoning for the subject parcel, Development Permit 3510 for a moved in dwelling should have been considered as a discretionary permit and will need to be reprocessed. P -38/11 MOVED BY COUNCILLOR M. DOUGLASS that the Development Report be adopted as amended. ^ MOTION CARRIED fir+ 7. SUBDIVISIONS a) #2011 -0 -065 - NW 5 -15 -13 -W4M Joseph and Alejandra Baer (Owner) / (Applicant) To create one (1) new parcel approximately 6.62 acres (2.68 ha) in size, containing an existing farmstead, from a titled area of 160 acres (64.7 ha) The County Planner provided background information on the proposed subdivision. Alberta Transportation will allow the access to stay the same on a temporary basis. P -39/11 MOVED BY COUNCILLOR C. AMULUNG that the Municipal Planning Commission APPROVE subdivision #2011 -0 -065, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant submit to the Subdivision Authority a copy of a sketch from an Alberta Land Surveyor that certifies the location and dimensions of the existing buildings and the exact dimensions of the lot to be subdivided MOTION CARRIED b) #2011 -0 -075 - SW 4 -15 -13 -W4M Sherrie and Lee Nygaard (Owner) / (Applicant) May 19, 2011 Municipal Planning Commission Page 2 To create one (1) new parcel approximately 10.33 acres (4.18 ha) in size, containing an existing farmstead, from a titled area of 160 acres (64.7 ha) The County Planner provided background information on the proposed subdivision. Alberta Transportation requires that one access be removed at the owner's expense. Concerns were raised regarding the possible need for an easement across the residual land for access to a neighboring property. The County Planner replied that it has been left for the landowners to resolve amongst themselves. M.P.C. questioned the need to remove the corrals. The County Planner explained that the landowner does not need to remove the corrals but that they cannot have more than 300 head of cattle and that the County of Newell needs to have a letter on file stating that the capacity of the corrals is below the 300 head threshold. AMULUNG that the Municipal Planning Commission APPROVE subdivision #2011 -0 -075, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant submit to the Subdivision Authority a copy of a sketch from an Alberta Land Surveyor that certifies the location and dimensions of the existing buildings and the exact dimensions of the lot to be subdivided. 3. That the applicant file a letter from the NRCB indicating that the deemed permits for the existing confined feeding operation on the parcel being created have been cancelled. 4. That the applicant submits to the Subdivision Authority a copy of a roadside development permit from Alberta Transportation with approves the removal of one of the existing highway access points to the proposed farmstead. MOTION CARRIED Left the meeting 10:22 a.m. Councillor B. de Jong declared a pecuniary interest and left the meeting 8. AGRICULTURAL SUPPORT SERVICE & HOME OCCUPATION PERMITS a) HO 234 - Renewal - SE 7 -20 -14 W4M, Division 8 Rock Lake Dairy (Owner) / Alta #1242363(Applicant) Renewal of existing Agriculture and Commercial Repair service. The Manager of Planning and Development provided background information on the proposed development permit and noted that it is a permanent permit. P -41/11 MOVED BY COUNCILLOR M. NESBITT that the Municipal Planning Commission APPROVE Home Occupation Permit #234 and grant approval for the renewal of an existing Agriculture and Commercial repair service subject to the following conditions: May 19, 2011 Municipal Planning Commission Page 3 This permit is being granted only for the operation of a business that repairs agricultural and commercial equipment and vehicles on lands legally described as SE 7 -20 -14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) All Federal, Provincial and Municipal statutes, regulations, codes and standards. b) The provisions of Land Use Bylaw #1626 -07, and amendments thereto, pertaining to the Agricultural District. c) All Alberta Building Codes where applicable. If the developer is required to obtain a building permit, it is his / her responsibility to do so, and furthermore, this permit must be obtained from an accredited inspection agency. d) Any other required permits, including electrical, heating & ventilation, gas and /or plumbing. All permits must be obtained from an accredited inspection agency. Subject to the following conditions e) That this development is located as shown on the site plan approved in this application and submitted April 25, 2011. Any changes to that plan shall require the written approval from the Development Officer. f) That there is no more than 1 resident employee involved in the operation of this business. g) That there is no advertising or display of produce being permitted on the property except for one indirectly illuminated sign of 1 m placed flat against the building or fence. DEVELOPMENT PERMITS a) Permit #3506 - Lot 12, Block 2, Plan 781 1389, NE 19 -15 -15 W4M, Division 4 Echo Chandler (Owner) / Scandia Honey Corporation (Applicant) Installation of a manufactured dwelling The Manager of Planning and Development provided background information on the proposed development permit. There was concern by M.P.C. on whether the manufactured home would fit in with the other dwellings in the neighbourhood and that possibly a site inspection should be done. It was noted that no comments have been received from the Scandia Hamlet Advisory Board and the Manager of Planning and Development noted that there was a security deposit taken and if it the applicant misrepresented himself they would have to remove the dwelling. c P -42/11 MOVED BY COUNCILLOR A. EASTMAN that the Municipal Planning Commission APPROVE Development Permit #3506 and grant approval for May 19, 2011 Municipal Planning Commission Page 4 the installation of a manufactured dwelling subject to the following conditions: This permit is being granted only for the installation of a 944 ft (87.7 m manufactured dwelling on lands legally described as Lot 12, Block 2, Plan 781 1389, NE 19 -15 -15 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) All Federal, Provincial and Municipal statutes, regulations, codes and standards. b) The provisions of Land Use Bylaw #1626 -07, and amendments thereto, pertaining to the Hamlet Residential District. c) All Alberta Building Codes where applicable. If the developer is required to obtain a building permit, it is his / her responsibility to do so, and furthermore, this permit must be obtained from an accredited inspection agency. d) Any other required permits, including electrical, heating & ventilation, gas and /or plumbing. All permits must be obtained from an accredited inspection agency. Reasons for Approval The Municipal Planning Commission has approved DP #3506 for the following reasons: 1. The proposed development complies with both the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Hamlet Residential District (Schedule 2), Standards of Development (Schedule 4) and Development Standards for Manufactured, Mobile, Modular, and RTM Homes (Schedule 9), as specified in the County of Newell Land Use Bylaw #1626 -07. 3. As no objections have been received from adjacent landowners or referral agencies with respect to the proposed development, the Development Authority has granted an approval. Subject to the following conditions a) That this development is located as shown on the site plan approved in this application and submitted April 21, 2011. Any changes to that plan shall require the written approval from the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That the developer provide the County of Newell with a security deposit in the amount of $5,000.00 to ensure that the requirement of the following condition is met: i) Once installed, this moved -in dwelling must be in equivalent condition as shown in the pictures provided on April 21, 2011. d) That the following setbacks are maintained for this development: Front (Timko St): 20 ft (6 m) Side (north east and south west): 5 ft (1.5 m) Rear (alley): 20 ft (6 m) •.. e) That there is a 2 m (6.6 ft.) separation distance between the dwelling and any other structures. f) That the manufactured home is skirted with materials the same as or consistent with the remainder of the building. May 19, 2011 Municipal Planning Commission Page 5 g) The developer must start construction before May 31, 2012 and be completed by May 31, 2013. In the event that either of these dates are not met, the developer may be required to apply for a new permit. MOTION CARRIED 10. POST AGENDA Lathom School Sign Site Councillor Bulger reported that the owner of land where a former school site is located is preparing to sell the property. He has enquired about subdividing out a small area which includes the historical sign identifying the former school site and has expressed interest in donating that land to the County. He would like to know the minimum parcel size that the County would accept as a donation to have the sign remain. It was confirmed that the concept behind the old school site sign program is for the subject area to remain in the title and future maintenance of the sign to be provided by the landowners rather than donating the site to the County. Councillor Bulger is going to speak with the landowner in an effort to clarify the program and determine whether additional consideration is required regarding this request. 11.
