MUNICIPAL PLANNING COMMISSION MEETING
July 21, 2011
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, AB on Thursday, July 21, 2011 commencing at
10:03 a.m.

a) DELEGATION
Funeral Home
Chris Thom introduced himself and explained that he has been looking
at property in the City of Brooks and County of Newell for an appropriate
place to start a funeral home. Mr. Thom has not applied for a permit but
wanted to explain what he would like and answer any questions the
M.P.C. may have regarding a funeral home in the County of Newell. He
has a parcel in mind near the Horticultural Centre. He explained that
funeral homes are regulated by the Provincial Government and when
questioned about disposing of fluid he responded that there is no
legislation for how fluid is disposed however there would be no harmful
chemicals such as formaldehyde flushed, therefore will not affect the
environment. The County Planner pointed out that the land in question
is zoned Urban Fringe and that funeral homes are not listed as a use in
the County bylaw. She also noted that there is no direct access to the
parcel via a public road, the only access is a private road going through
the Horticultural Centre and that the applicant would require an
easement agreement with the Medicine Hat College and Horticultural
Centre. The County Planner explained that the site is not serviced with
sanitary sewer or water. Mr. Thom responded that the parcel is 24 acres
with a long drive with a double septic field and commercial boiler with
room for expansion. The M.P.C. had concerns about the maintenance of
the driveway. Mr. Thom replied that currently the owners utilize a
commercial snow removal company and that would continue. The
County Planner reiterated that zoning and access issues would have to
be addressed in the event that an application is submitted. Mr. Thom
thanked M.P.C. for the opportunity to meet and discuss this proposed
development.

6. SUBDIVISIONS
+' a) #201.1 -0 -105 - NE 21 -18 -14 -W4M, Division 5

To subdivide an approximate 4.72 ha (12 acre) parcel from a portion of
the NE 21- 18 -14, which is proposed to be consolidated with an adjacent
quarter section SE 21 -18 -W4M.
The County Planner provided background information on the proposed
subdivision. It was noted that the application was presented to the
I.M.D.P. and there were no concerns. The County Planner explained
that it was a reconfiguration and there may be a need for a 20 metre
road access easement to service the consolidated parcel.
P -61/11 MOVED BY COUNCILLOR B. DE.ONG that the Municipal Planning
Commission APPROVE subdivision #2011 -0 -105, subject to the following
conditions:
1. That all outstanding property taxes shall be paid to the County of
Newell.
2. That the subdivided portion of NE 21 -18 -14 -W4M be consolidated with
the adjacent quarter section SE 21 -18 -W4M in a manner such that the
resulting Certificate of Title could not be subdivided without the approval
of the Subdivision Authority

7. HOME OCCUPATION PERMITS
a) HO 259 - SE 6 -15 -13 -W4M, Plan 821 1670, Block 1, Lot 18, Division 1

Excavating Operation
The Manager of Planning and Development provided background
information on the proposed development permit.
P -62/11 MOVED BY COUNCILLOR C. AMULUNG that the Municipal Planning
Commission APPROVE Home Occupation Permit #259 for an excavating
operation subject to the following conditions:
This permanent permit is being granted only for the excavating
operation on lands legally described as Lot 18, Block 1, Plan 821 1670,
SE 6 -15 -13 W4M. Any additional development shall require prior
approval of a separate permit application.
The proposed development complying with:
a) The provisions pertaining to the Hamlet Residential District and all
relevant schedules, as outlined in the County of Newell Land Use
Bylaw #1626 -07.
b) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
c) All Alberta Building Codes and Safety Codes, where applicable.

d) It is responsibility of the developer to obtain all permits from an
accredited inspection agency.
The Municipal Planning Commission has approved HO 259 for the
following reasons:
1. The proposed development complies with the Municipal Development
Plan.
2. The Development Authority is satisfied that the proposed
development is suitable for the purpose for which it is intended
under the Hamlet Residential District (Schedule 2), Standards of
Development (Schedule 4) and Home Occupation and Agricultural
Support Services (Schedule 13), as specified in the County of Newell
Land Use Bylaw #1626 -07.
3. No objections have been received from adjacent landowners or
referral agencies with respect to the proposed development.
Subject to the following conditions
e) That this development is located as shown on the site plan approved
in this application and submitted June 6, 2011. Any changes to that
plan shall require the written approval from the Development
Officer.
f) That there are no more than 2 resident employees and no non-
resident employees involved in the operation of this business.
g) That there is no advertising or display of produce being permitted on
the property except for one indirectly illuminated sign of 1 m2
placed flat against the building or fence.

8. DEVELOPMENT PERMITS
a) Permit #3528 - SW 20 -15 -15 W4M, Division 4

Dwelling with attached garage; variance to front yard setback
The Manager of Planning and Development provided background
information on the proposed development permit. It was noted that
the EID is currently working in the ditch so will arrange with applicant
on where to put the road approach.
P -63/11 MOVED BY COUNCILLOR R. ANDREWS that the Municipal Planning
Commission APPROVE Development Permit #3528 for a dwelling with
attached garage and variance to the front yard setback subject to the
following conditions:
This permit is being granted only for the installation of a 3152 ft (292.8
m single detached dwelling with attached 2 -car garage, and with a
variance to the front yard setback, on lands legally described as SW 20-
15-15 W4M. Any additional development shall require prior approval of a
separate permit application.
The proposed development complying with:
a) The provisions pertaining to the Hamlet Residential District and all
relevant schedules, as outlined in the County of Newell Land Use
Bylaw #1626 -07.
b) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.

c) All Alberta Building Codes and Safety Codes, where applicable.
d) It is responsibility of the developer to obtain all permits from an

The Municipal Planning Commission has approved DP #3528 for the
following reasons:
1. The proposed development complies with both the Municipal
Development Plan.
2. The Development Authority is satisfied that the proposed
development is suitable for the purpose for which it is intended
under the Agricultural District (Schedule 2), and Standards of
Development (Schedule 4) as specified in the County of Newell Land
Use Bylaw #1626-07.
3. No objections have been received from adjacent landowners or
referral agencies with respect to the proposed development.
Subject to the following conditions
e) That this development is located as shown on the site plan approved
in this application and submitted June 15, 2011. Any changes to that
plan shall require the written approval of the Development Officer.
f) That the following setbacks on all sides are maintained for this
development:
Front (from RR 15 -5): 75 ft (23 m)
Side (north and south) 10 ft (3 m)
g) That the property is not used for conducting a business or
commercial operation without first obtaining the required permits.
h) The developer must start construction before July 30, 2012 and be
completed by July 30, 2013. In the event that either of these dates
cannot be met, the developer may be required to apply for a new
permit.

9. OTHER BUSINESS - Continued
b) Transmission Tower — NW 8 -21 -13 W4M
The Manager of Planning and Development provided background
information on the Transmission Tower. She explained that there was a
request for a Development Permit in May for a Telecommunications
tower in Division 3. After checking requirements from Industry Canada,
they have already circulated to adjacent landowners. It was also noted
by the Manager of Planning and Development that they are exempt for a
Development Permit from the County but that they have requested a
letter of concurrence. M.P.C. responded that the Manager of Planning
and Development should write the letter of concurrence and to include
that they must ensure that all landowner concerns are dealt with.
P -64/11 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning
Commission supports the letter of concurrence with the above stated
condition.
