MUNICIPAL PLANNING COMMISSION MEETING
August 11, 2011
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, AB on Thursday, August 11, 2011 commencing at
10:02 a.m.

6. DEVELOPMENT PERMITS
a) Permit #3537 - NE 34 -18 -15 W4M, Division 5

Remove part of an existing dwelling; construct addition
The Manager of Planning and Development provided background
information on the proposed development permit. It was noted that
there are two dwellings that are going to be moved together to create
one. There were concerns from council regarding the age of the
manufactured home. The Manager of Planning and Development
responded that the age of the home to be removed is 1973 and the
home that is staying is 1989. This permit was presented to the IMDP
committee and was recommended for approval.
P -67/11 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning
Commission APPROVE Development Permit #3537 for the removal of
part of an existing dwelling and construction of an addition subject to
the following conditions:
This permit is being granted only to reconstruct an existing dwelling as
described in this report, on lands legally described as NE 34 -18 -15 W4M.
Any additional development shall require prior approval of a separate
permit application.
Reasons for Approval
The proposed development complies with both the Municipal
Development Plan and the Intermunicipal Development Plan.
1. The Development Authority is satisfied that the proposed
development is suitable for the purpose for which it is intended under
the Light Industrial District (Schedule 2), Standards of Development
(Schedule 4) and Moved -In Dwellings (Schedule 10), as specified in
the County of Newell Land Use Bylaw #1626 -07.
The proposed development complying with:
a) The provisions pertaining to the Light Industrial District and all
relevant schedules, as outlined in the County of Newell Land Use
Bylaw #1626-07.
b) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
c) All Alberta Building Codes and Safety Codes, where applicable.

d) It is responsibility of the developer to obtain all permits from an
accredited inspection agency.
Conditions of Development
a) That this development is located as shown on the site plan approved
in this application and submitted July 11, 2011. Any changes to that
plan shall require the written approval of the Development Officer.
b) That the property is used only for the operation of P &H Oilfield
Maintenance Ltd. No other business or commercial operation may be
conducted from this parcel without first obtaining a proper permit.
c) That there is a 2 m (6.6 ft.) separation distance between the
dwelling and any other existing building.
d) That the following setbacks on all sides are maintained for this
development:
Front (SH 542): 50 m (AB Transportation setback
requirement)

Installation of an advertising sign
The Manager of Planning and Development provided background
information on the proposed development permit. The operation is an
existing business that was approved in 2006. Alberta Transportation
has issued their permit for this application. This permit was presented
to IMDP and recommended for approval.
P -68/11 MOVED BY COUNCILLOR C. AMULUNG that the Municipal Planning
Commission APPROVE Development Permit #3539, for the installation of an
advertising sign subject to the following conditions:
This permit is being granted only for the installation of a free standing
advertising sign to be used for the advertising of products sold by New -
Way Irrigation Ltd, on lands legally described as SE 8- 19- 14 -W4M. Any
additional development shall require prior approval of a separate permit
application.
Reasons for Approval
1. The proposed development complies with both the Municipal
Development Plan and the Intermunicipal Development Plan.
2. The Development Authority is satisfied that the proposed
development is suitable for the purpose for which it is intended
under the Country Residential District (Schedule 2), Standards of
Development (Schedule 4) and Development Standards for
Manufactured, Mobile, Modular, and RTM Homes (Schedule 9), as
specified in the County of Newell Land Use Bylaw #1626 -07.
The proposed development complying with:
a) The provisions pertaining to the Commercial District and all relevant
schedules, as outlined in the County of Newell Land Use Bylaw
# 1626 -07.

b) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.

Conditions of Development
a) That this development is located as shown on the site plan approved
in this application and submitted July 27, 2011. Any changes to that
plan shall require the written approval of the Development Officer.
b) That the sign installation follow the setback requirements approved
by the Alberta Transportation permit, as follows:
Northwest property line: 135 ft (41 m)
Northeast property line: 3 ft (10 m)

Councillor A. Eastman declared a pecuniary interest and left the meeting at 10:09 a.m.
The Manager of Planning and Development provided background
information on the proposed development permit. It was noted that
the Development Permit is in association with a subdivision. EID
responded that nothing can be located on the EID pipeline. There are
letters included in the package from adjacent landowners regarding
their agriculture operations. There was concern from council about the
permit and subdivision being applied at the same time. The County
Planner responded that the development permit can be approved as a
second dwelling, the end result would be the same. It was noted that
the second dwelling is for family that are intending on helping with the
operation.
P -69/11 MOVED BY COUNCILLOR I. SCHROEDER that the Municipal Planning
Commission APPROVE Development Permit #3531, for the installation of
moved -in dwelling with attached garage and deck subject to the following
conditions:
This permit is being granted only for the installation of a 3131 ft (290.8
m 1991 moved -in dwelling with attached garage and deck, on lands
legally described as SW 26 -21 -16 W4M. Any additional development
shall require prior approval of a separate permit application.
Reasons for Approval
1. The proposed development complies with both the Municipal
Development Plan and the Land Use Bylaw.
2. The Development Authority is satisfied that the proposed
development is suitable for the purpose for which it is intended
under the Agricultural District (Schedule 2), Standards of
Development (Schedule 4) and Moved -in Buildings (Schedule 10), as
specified in the County of Newell Land Use Bylaw #1626 -07.

a) The provisions pertaining to the Agricultural District and all relevant
schedules, as outlined in the County of Newell Land Use Bylaw

c) All Alberta Building Codes, where applicable. If the developer is
required to obtain a building permit, it is his / her responsibility to
do so, and furthermore, this permit must be obtained from an
accredited inspection agency.
d) All Alberta Safety Codes, where applicable. If the developer is
installing a new sewage disposal system, he /she is required obtain
a Private Sewage Disposal System Permit, issued by a licensed,
accredited inspection agency.
e) Any other required permits, including electrical, heating &
ventilation, gas and /or plumbing. All permits must be issued by a
licensed agency.
Conditions of Development
a) That this development is located as shown on the site plan approved
in this application and submitted July 4, 2011. Any changes to that
plan shall require the written approval of the Development Officer.
b) That the following setbacks on all sides are maintained for this
development:
Front (from TR 21 -4): 100 ft (30 m)
Side and Rear (East, West and North): a minimum of 10 ft
(3 m) setback from the boundaries created by the new
parcel (subdivision 2010 -0 -121)
c) That the property is not used for conducting a business or
commercial operation without first obtaining the required permits.
d) The developer must start construction before August 25, 2012 and
be completed by August 25, 2013. In the event that either of these
dates are not met, the developer may be required to apply for a new
permit.

To create one new vacant lot from a titled area of 160 acres for Country
Residential use.
The County Planner provided background information on the proposed
subdivision. It was noted that there are responses from adjacent
landowners regarding the agriculture operations in the area. The
County Planner is removing the approach agreement from the conditions
as per notice from the County Public Works.

P -70/11 MOVED BY COUNCILLOR M. NESBITT that the Municipal Planning
Commission APPROVE subdivision #2011 -0 -121, subject to the following
conditions:
1. That all outstanding property taxes shall be paid to the County of
Newell.
2. That the applicant or owner or both enter into an agreement with the
County of Newell for the installation of any required road approaches to
the proposed or remnant parcels.

Report.

8. HOME OCCUPATION PERMITS
a) HO 260 - NE 2 -17 -13 W4M, Division 2

Supply safety units to oilfield and construction sites.
The Manager of Planning and Development provided background
information on the proposed development permit. It was noted that it
is an existing business. The units are usually located on the work site
with one or two in the yard at any time.
P72 -/11 MOVED BY COUNCILLOR I. SCHROEDER that the Municipal Planning
Commission APPROVE Home Occupation Permit #260 for the business of
supplying safety units to oilfield and construction sites subject to the following
conditions:
This permanent permit is being granted only for the supply of safety units
on lands legally described as NE 2 -17 -13 W4M. Any additional development
shall require prior approval of a separate permit application.
Reasons for Approval
1. The proposed development complies with the Municipal Development
Plan.
2. The Development Authority is satisfied that the proposed
development is suitable for the purpose for which it is intended
under the Agricultural District (Schedule 2), Standards of
Development (Schedule 4) and Home Occupation and Agricultural
Support Services (Schedule 13), as specified in the County of Newell
Land Use Bylaw #1626 -07.
3. No objections have been received from adjacent landowners or
referral agencies with respect to the proposed development.
The proposed development complying with:

a) The provisions pertaining to the Agricultural District and all relevant
schedules, as outlined in the County of Newell Land Use Bylaw
#1626-07.
b) All Federal, Provincial and Municipal statutes, regulations, codes and

d) It is responsibility of the developer to obtain all permits from an
accredited inspection agency.
Conditions of Development
a) That this development is located as shown on the site plan approved
in this application and submitted July 18, 2011. Any changes to that
plan shall require the written approval from the Development
Officer.
b) That there are no more than 2 resident employees and 1 non-
resident employee involved in the operation of this business.
c) That there is no advertising or display of produce being permitted on
the property except for one indirectly illuminated sign of 1 m2
placed flat against the building or fence.

To create one new lot from a titled area of 2.42 acres for Country
Residential use.
The County Planner provided background information on the proposed
subdivision. The application was brought to M.P.C. because it requires
a waiver on the size of the parcel being subdivided out. Both dwellings
have individual sewer and water and Alberta Transportation approved
the use of a joint driveway. It was noted that with the limited size of
the parcel if the manufactured home that is currently on the parcel is
removed it would likely need to be replaced with another manufactured
home.
P -73/11 MOVED BY COUNCILLOR M. NESBITT that the Municipal Planning
Commission APPROVE subdivision #2011 -0 -124, subject to the following
conditions:
1. That all outstanding property taxes shall be paid to the County of
Newell.
2. That the applicant submit to the Subdivision Authority a copy of a sketch
from an Alberta Land Surveyor that certifies the location and dimensions
of the existing buildings and the exact dimensions of the lot to be
subdivided.
3. That the easements as required by FortisAlberta or any other utility
agency or the municipality shall be established prior to finalization of the
application and are to be registered simultaneously with the legal plan of
the subdivision.

Extension request for installation of manufactured home.
The Manager of Planning and Development gave background information on
the extension request for permit 3334. It was noted that the ratepayer had
applied for an extension in 2010 and normally there would not be another
extension but in this case there are extenuating circumstances.

Commission APPROVE Development Permit 3334 one year extension.
