CALL TO ORDER The Chairman called the meeting to order at 10:02 a.m. 2. EXCUSED FROM MEETING P-75/11 MOVED BY COUNCILLOR M. NESBITT that Councillor R. Andrews be excused from the meeting. MOTION CARRIED 3. MINUTES a) August 11, 2011 P-76/11 MOVED BY COUNCILLOR M. DOUGLASS that the minutes of the August 11, 2011 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 'i✓ 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-77/11 MOVED BY COUNCILLOR A. EASTMAN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT AUGUST 1-31, 2011 The Manager of Planning and Development provided background on the Development Report. It was noted that DP 3545 was on the report in error and is a discretionary permit. P-78/11 MOVED BY COUNCILLOR I. SCHROEDER that the Development Report be adopted as presented. MOTION CARRIED The Manager of Planning and Development presented a construction permit report. She reviewed the report with M.P.0 and questioned if this was a report that they would like to see on a regular basis. The response from M.P.0 was that they would like to see a quarterly report separated into Commercial and Residential permits. Left the Meeting 10:08 a.m. Councillor L. Juss 7. SUBDIVISIONS a) #2011-0-132 - NW 16-19-15-W4M Margaret Seaton (Owner) / (Applicant) To separate an existing farmstead of 8.50 acres from a titled area of 150.7 acres (60.9 ha) The County Planner provided background information on the proposed subdivision. It was noted by M.P.C. that the rural road on the report should be 15-4. P-79/11 MOVED BY COUNCILLOR M. NESBITT that the Municipal Planning Commission APPROVE subdivision #2011-0-132, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant submit to the Subdivision Authority a copy of a sketch from an Alberta Land Surveyor that certifies the location and dimensions of the existing buildings and the exact dimensions of the lot to be subdivided. MOTION CARRIED September 8,2011 Municipal Planning Commission Page 2 b) #2011-0-133 - SW 23-17-13-W4M Jim &Jennifer Aleman (Owner) / (Applicant) To separate an existing farmstead from a titled area of 160 acres (64.7 ha). The parcel to be subdivided is legally known as the SW 23-17-13 W4M. The County Planner provided background information on the proposed subdivision. It was stated that Public Works requires an upgrade to the approach. The County Planner noted that the air photo is from a few years ago and the applicants have now filled in the ditch. P-80/11 MOVED BY COUNCILLOR I. SCHROEDER that the Municipal Planning Commission APPROVE subdivision #2011-0-133, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant enters into an agreement with the County of Newell for the installation of any required road approaches to the remnant parcel, specifically the approach from Range Road 13-2. 3. That the applicant submit to the Subdivision Authority a copy of a sketch from an Alberta Land Surveyor that certifies the location and dimensions of the existing buildings and the exact dimensions of the lot to be subdivided. MOTION CARRIED c) #2011-0-136 - Lot 1, Block 3, Plan 0511627, NW 7-19-14-W4M Coleterra Properties Inc. / Deranway Enterprises Ltd. (Owner) / (Applicant) To adjust an existing parcel boundary by subdividing a 2.9 acre (.182 ha) portion of an adjacent title and consolidating it to create a new parcel approximately 3.0 acres (1.242 ha) in size. The County Planner provided background information on the proposed subdivision. P-81/11 MOVED BY COUNCILLOR L. 7USS that the Municipal Planning Commission APPROVE subdivision #2011-0-136, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the subdivided portion of the NW 7-19-14 W4M be consolidated with the adjacent parcel legally known as Lot 1, Block 3, Plan 0511627 in a manner such that the resulting Certificate of Title could not be subdivided without the approval of the Subdivision Authority. MOTION CARRIED d) #2011-0-138- Lot 1, Block G, Plan 8111583, NE 29-20-14-W4M Mark & Ronda Porter (Owner) / (Applicant) To subdivide an existing 4.4 acre (1.7 ha) parcel into two titles approximately 2.60 acres (1.052 ha and 1.80 acres (.666 ha) in size respectively. The County Planner provided background information on the proposed subdivision. There was concern from M.P.C. regarding the service road maintenance and it being brought to County Standards. The discussion by M.P.C. was that Public Works will inspect the road to ensure that it is September 8,2011 Municipal Planning Commission Page 3 {)0, up to County Standards before taking over the maintenance. The County Planner noted that access to parcels is one of the items being to*- discussed in the new Land Use Bylaw. P-82/11 MOVED BY COUNCILLOR B. DE5ONG that the Municipal Planning Commission APPROVE subdivision #2011-0-138, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant enter into a Development Agreement with the County of Newell which shall be registered concurrently with the final plan against the title(s) being created regarding the construction of service road access. 3. That the applicant submit to the Subdivision Authority a copy of a sketch from an Alberta Land Surveyor that certifies the location and dimensions of the existing buildings and the exact dimensions of the lot to be subdivided. MOTION CARRIED e) #2011-0-140 - NE 17-19-15-W4M Neil & Gail Anderson (Owner) / (Applicant) To create one (1) new parcel approximately 5.48 acres (2.22 ha) in size, containing an existing farmstead from a titled area of 160 acres (64.7 ha) for Country Residential use. NESBITT that the Municipal Planning Commission APPROVE subdivision #2011-0-140, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant enters into an agreement with the County of Newell for the installation of any required road approaches to the proposed or remnant parcel. 3. That the applicant submit to the Subdivision Authority a copy of a sketch from an Alberta Land Surveyor that certifies the location and dimensions of the existing buildings and the exact dimensions of the lot to be subdivided. MOTION CARRIED 8. AGRICULTURAL SUPPORT SERVICE & HOME OCCUPATION PERMITS a) HO 144 - RENEWAL - Lot 5, Block 1, Plan 8311352, NE 5-20-14- W4M Bernard & Donalda Elsbett (Owner) / (Applicant) Renewal of a rural water hauling business The Manager of Planning and Development provided background information on the proposed development permit and noted that this is their third renewal and will now be a permanent permit. DEJONG that the Municipal Planning Commission APPROVE Home Occupation Permit 144 for the operation of a rural water hauling business subject to the following conditions: This permanent permit is being granted only for the operation of a rural water hauling business on lands legally described as Lot 5, Block 1, Plan 831 1352, NE 5-20-14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Country Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is responsibility of the developer to obtain all permits from an accredited inspection agency. The Municipal Planning Commission has approved HO 144 for the following reasons: 1. The proposed development complies with the Municipal Development Plan 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Country Residential District (Schedule 2), Standards of Development (Schedule 4) and Home Occupation and Agricultural Support Services (Schedule 13), as specified in the County of Newell Niko- Land Use Bylaw #1626-07. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted August 15, 2011. Any changes to that plan shall require the written approval from the Development Officer. b) That there are no more than 2 resident employees involved in the operation of this business. c) That there is no advertising or display of produce being permitted on the property except for one indirectly illuminated sign of 1 m2 placed flat against the building or fence. MOTION CARRIED b) HO 261 - NW 8-16-13 W4M, Division 2 Brooklyn Cattle Co. and Elliott Cats Ltd. / Duane & Elizabeth Elliott (Owner) / (Applicant) Road construction and maintenance operation The Manager of Planning and Development provided background information on the proposed development permit. She noted that the Home Occupation permit was in conjunction with Development Permit 3546. There was concern from M.P.C. about the company growing and requiring a change of zoning in the future. The Manager of September 8,2011 Municipal Planning Commission Page 5 Planning and Development responded that it is up to the landowner to let the County know if there is significant changes but the permit does allow for some growth. Nome P-85/11 MOVED BY COUNCILLOR I. SCHROEDER that the Municipal Planning Commission APPROVE Home Occupation Permit #261 for a road construction and maintenance operation subject to the following conditions: This permanent permit is being granted only for the road construction and maintenance operation on lands legally described as NW 8-16-13 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is responsibility of the developer to obtain all permits from an accredited inspection agency. The Municipal Planning Commission has approved HO 261 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2), Standards of Development (Schedule 4) and Home Occupation and Agricultural Support Services (Schedule 13), as specified in the County of Newell Land Use Bylaw #1626-07. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted August 19, 2011. Any changes to that plan shall require the written approval from the Development Officer. b) That there are no more than 2 resident employees and 3 non- resident employees involved in the operation of this business. c) That the proposed moved-in building (DP 3546) is not used for living purposes. d) That there is no advertising or display of produce being permitted on the property except for one indirectly illuminated sign of 1 m2 placed flat against the building or fence. DEVELOPMENT PERMITS a) Permit #3546 - NW 8-16-13 W4M, Division 2 r Duane & Elizabeth Elliott (Owner) / (Applicant) Installation of a moved in building The Manager of Planning and Development provided background information on the proposed development permit. P-86/11 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning Commission APPROVE Development Permit #3546 for the installation of a moved-in building subject to the following conditions: This permit is being granted only for the installation of a 552 ft2 (51 m2) 1995 Atco trailer on lands legally described as NW 8-16-13 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is responsibility of the developer to obtain all permits from an accredited inspection agency. The Municipal Planning Commission has approved DP #3546 for the following reasons: 1. The proposed development complies with both the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2), Standards of Development (Schedule 4) and Moved-in Buildings (Schedule 10), as specified in the County of Newell Land Use Bylaw #1626-07. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted August 19, 2011. Any changes to that plan shall require the written approval of the Development Officer. b) That the following setbacks on all sides are maintained for this development: Front (from SH 875):40 m (131 ft) as per AB Transportation requirement Side and Rear (East, West and North): n/a c) That the proposed moved-in building is not used for living purposes. d) The developer must start installation before September 22, 2012 and be completed by September 22, 2013. In the event that either of these dates are not met, the developer may be required to apply for a new permit. MOTION CARRIED September 8,2011 Municipal Planning Commission Page 7 10.
