Douglass, Councillor C. Amulung, Councillor M. Nesbitt, Councillor L. Juss, Councillor A. Eastman, Councillor B. de Jong, Councillor J. Bulger, Councillor A.M. Philipsen, Councillor & M.P.C. Chair I. Simpson, Administrative Assistant OTHERS IN ATTENDANCE: S. Stanway, Brooks Bulletin 1. CALL TO ORDER The Chairman called the meeting to order at 10:01 a.m. 2. EXCUSED FROM MEETING There were no members excused from the meeting. 3. MINUTES a) September 8, 2011 ��4 P-87/11 MOVED BY COUNCILLOR B. DE3ONG that the minutes of the September 8, 2011 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-88/11 MOVED BY COUNCILLOR M. NESBITT that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS a) Permit #3545 - Block 4 & 7, Plan 7510619, NE 8-19-14 W4M, Division 10 MacBain Properties (Sanjel) / Mark Smolarski-MDS Design (Owner) / (Applicant) Compliance for an existing maintenance shop, existing auxiliary building, and yard; construction of an addition to the existing shop; variance to side yard setback. The Manager of Planning and Development provided background information on the proposed development permit. It was noted that this permit will bring the entire operation into compliance. A letter received from an adjacent landowner was reviewed. The letter expressed concerns regarding the side yard setback and future implications this may have on the neighbouring parcel. The Manager of Planning and Development responded that she had discussed this with the County Planner and it is not the liability of the County of Newell but a legal matter between the landowners. P-89/11 MOVED BY COUNCILLOR A. EASTMAN that the Municipal Planning Commission APPROVE Development Permit #3545 for compliance to an existing maintenance shop, existing auxiliary building, and yard; construction of an addition to the existing shop; variance to side yard setback subject to the following conditions: This permit is being granted only to provide compliance for an existing 10,455 ft2 (971.3 m2) maintenance and repair shop, with a variance to the side yard setback requirement. It also provides compliance for an existing 9459 ft2 (878 m2) auxiliary building and the storage yard associated with the business. Finally, the permit grants approval for the construction of a 335.8 ft2 (31.2 m2) addition to the existing shop, on lands legally described as Block 4 & 7, Plan 751 0619 1302, NE 8-19-14 W4M. Any additional development shall require prior approval of a separate permit application. September 22,2011 Municipal Planning Commission Page 2 A,\JR • The proposed development complying with: a) The provisions pertaining to the Industrial District and all relevant Sw, schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is responsibility of the developer to obtain all permits from an accredited inspection agency. Reasons for Approval 1. The proposed development complies with both the Municipal Development Plan and the Intermunicipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Country Residential District (Schedule 2), Standards of Development (Schedule 4) and Development Standards for Manufactured, Mobile, Modular, and RTM Homes (Schedule 9), as specified in the County of Newell Land Use Bylaw #1626-07. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Subject to the following conditions a) That this development is located as shown on the site plan approved in this application and submitted August 15, 201. Any changes to that plan shall require the written approval of the Development Officer. b) That the exterior of the proposed addition is sided with materials the same as, or consistent with, the exterior of the existing building. c) That neither the shop, the addition to the shop, or the auxiliary building is used for living purposes. d) That access can be provided for Emergency Services vehicles to the east, south and west sides of the building. e) That the following setbacks on all sides are maintained for this development: Front and Rear (east and west): 20 ft (6 m) Side (north): 4.5 ft (1.2 m) - variance Side (south): 10 ft (3 m) MOTION CARRIED 7.
