CALL TO ORDER The Chairman called the meeting to order at 10:02 a.m. 2. EXCUSED FROM MEETING All members were present. 3. MINUTES a) September 22, 2011 P-90/11 MOVED BY COUNCILLOR M. NESBITT that the minutes of the September 22, 2011 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-91/11 MOVED BY COUNCILLOR A. EASTMAN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Manager of Planning and Development provided background on the Development Report. There was question from M.P.C. regarding the size of the water tanks, the Manager of Planning and Development responded that there are 2 tanks holding 500 thousand gallons each. P-92/11 MOVED BY COUNCILLOR B. DEJONG that the agenda be adopted as presented. MOTION CARRIED 7. DEVELOPMENT PERMITS a) Permit #3550 - NW 30-18-15 W4M, Division 5 Russell and Muriel Leveque / Phil Leveque (Owner) / (Applicant) Installation of a moved-in building; variance to the front yard setback. The Manager of Planning and Development provided background information on the proposed development permit. It was noted that this application was only brought to M.P.C. because it required a variance and that the applicant will be improving the appearance of the building once it is moved on site. P-93/11 MOVED BY COUNCILLOR M. NESBITT that the Municipal Planning Commission APPROVE Development Permit #3550 for the installation of a moved-in building; variance to the front yard setback subject to the following conditions: This permit is being granted only for the installation of a 832 ft2 (77.3 m2) moved-in building with a variance to the front yard setback requirement, on lands legally described as NW 30-18-15 W4M. Mr The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is responsibility of the developer to obtain all permits from an accredited inspection agency. The Municipal Planning Commission has approved DP #3550 for the following reasons: 1. The proposed development complies with both the Municipal Development Plan and the Intermunicipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2), Standards of Development (Schedule 4) and Moved-in Buildings (Schedule 10), as specified in the County of Newell Land Use Bylaw #1626-07. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted September 12, 2011. Any changes to that plan shall require the written approval of the Development Officer. b) That the following setbacks on all sides are maintained for this development: Front (east): 60 ft (18 m) - variance to 100 ft (30 m) setback requirement Side and Rear (south and west): 10 ft (3 m) c) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. d) The developer must install the building before October 25, 2012 and be completed by October 25, 2013. In the event that either of these dates are not met, the developer may be required to apply for a new permit. MOTION CARRIED b) Permit #3551 - NW 31-18-15 W4M, Division 5 Victor and Karen Getz / Jennifer Getz (Owner) / (Applicant) Installation of a manufactured dwelling The Manager of Planning and Development provided background information on the proposed development permit. It was noted that there is also a subdivision in process for this landowner that has been approved. In referrals the Public Works Department has requested an access agreement which has been provided. NESBITT that the Municipal Planning Commission APPROVE Development Permit #3551 for the installation of a manufactured dwelling subject to the following conditions: This permit is being granted only for the installation of a 1216 ft2 (113 m2) 2011 manufactured dwelling, on lands legally described as NW 31- 18-15 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is the responsibility of the developer to obtain all permits from an accredited inspection agency. The Municipal Planning Commission has approved DP #3551 for the following reasons: 1. The proposed development complies with both the Municipal Development Plan and the Intermunicipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2), Standards of Development (Schedule 4) and Development Standards for Manufactured, Mobile, Modular, Ready-to-Move (RTM) Homes (Schedule 9), as specified in the County of Newell Land Use Bylaw #1626-07. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted September 12, 2011. Any changes to that plan shall require the written approval of the Development Officer. b) That the following setbacks on all sides are maintained for this development: Front (east): 60 ft (18 m) - variance to 100 ft (30 m) setback requirement Side and Rear (south and west): 10 ft (3 m) c) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. d) That the developer enter into an access agreement with the adjacent landowner to the east of the parcel in order to provide access to the proposed development. e) The developer must install the building before October 25, 2012 and be completed by October 25, 2013. In the event that either of these dates are not met, the developer may be required to apply for a new permit. ��..� MOTION CARRIED October 6,2011 Municipal Planning Commission Page 4 c) Permit #3552- NE 19-15-15 W4M, Division 4, Scandia County of Newell / EID Historical Park (Owner) / (Applicant) Installation of a moved-in building The Manager of Planning and Development provided background information on the proposed development permit. It was noted that the cost of the renovation and moving the building is being covered by grants and that the County of Newell has requested a 5 year plan for the Historical Park. The Manager of Planning and Development read a letter from the applicant requesting a refund for the application fee due to the fact that it is a non-profit organization. M.P.C. accepted the proposal and will refund the application fee. P-95/11 MOVED BY COUNCILLOR R. ANDREWS that the Municipal Planning Commission APPROVE Development Permit #3552 for the installation of a moved-in building subject to the following conditions: This permit is being granted only for the installation of a 1000 ft2 (92.9 m2) moved-in CPR station building, on lands legally described as NE 19-15-15 W4. Any additional development shall require prior approval of a separate permit application The proposed development complying with: a) The provisions pertaining to the Public Service District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is responsibility of the developer to obtain all permits from an accredited inspection agency. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Public Service District (Schedule 2), Standards of Development (Schedule 4) and Development Standards for Moved-in Buildings (Schedule 10), as specified in the County of Newell Land Use Bylaw #1626-07. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted September 14, 2011. Any changes to that plan shall require the written approval of the Development Officer. b) That there is a 2 m (6.6 ft.) separation distance between the new building and any other buildings or structures on the site. c) That access can be provided for Emergency Services vehicles to all sides of the building. d) That the proposed building is not used for living purposes. October 6,2011 Municipal Planning Commission Page 5 e) That the following setbacks on all sides are maintained for this development: Front and Side: n/a Vine Rear (Railway Ave): 20 ft (6.1 m) f) The developer must start installation before October 24, 2012 and be completed by October 24, 2013. In the event that either of these dates are not met, the developer may be required to apply for a new permit. MOTION CARRIED 8. POST AGENDA 9. IN CAMERA ITEMS There were no in camera items. 10.
