CALL TO ORDER The Chairman called the meeting to order at 10:03 a.m. 2. EXCUSED FROM MEETING P-8/12 MOVED BY COUNCILLOR M. NESBITT that Councillor Eastman be excused from the meeting. MOTION CARRIED 3. MINUTES a) January 19, 2012 P-9/12 MOVED BY COUNCILLOR B. DEJONG that the minutes of the January 19, New 2012 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-10/12 MOVED BY COUNCILLOR M. DOUGLASS that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT P-11/12 MOVED BY COUNCILLOR I. SCHROEDER that the agenda be adopted as presented. MOTION CARRIED 7. SUBDIVISIONS a) #2012-0-007 - SW 28-20-14-W4M, Division 8 144160 Ramer Ranches Ltd. / John & Marjorie Sparling (Owner) / (Applicant) To subdivide a .64 acre (0.26 ha) portion of an existing 103.3 acre title which is proposed to be consolidated with the adjacent parcel (Block 1, Plan 8810676) The County Planner provided background information on the proposed subdivision noting that there will be a municipal reserve taken at $5000 per acre. P-12/12 MOVED BY COUNCILLOR B. DEJONG that the Municipal Planning Commission APPROVE subdivision #2012-0-007, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the subdivided portion of SW 28-20-14 be consolidated with the adjacent parcel legally known as Block 1, Plan 8810676 in a manner such that the resulting Certificate of Title could not be subdivided without the approval of the Subdivision Authority. 3. That any conditions of Alberta Transportation be satisfied prior to finalization. MOTION CARRIED *`r,r 8. DEVELOPMENT PERMITS �. February 9,2012 Municipal Planning Commission Page 2 a) Permit #3569 - NE 19-15-15 W4M, Division 4 County of Newell / EID Historical Park (Owner) / (Applicant) EID Historical Park Concept Plan The Manager of Planning and Development provided background information on the proposed development permit. It was noted that there were four structures on the property that already have a permit or do not require one. Chairman Philipsen expressed concern on condition "H" stating that no shipping containers were permitted. The Manager of Planning and Development responded that in the current County of Newell Bylaw there is no provision for shipping containers. H. Johnson, representative of the EID Historical Park Organization, added that the committee had already purchased a C-Can and is storing it in a place that cannot be seen by the public. The County Planner suggested that it be called storage and be limited to one on the parcel. P-13/12 MOVED BY COUNCILLOR R. ANDREWS that the Municipal Planning Commission APPROVE Development Permit #3569 for the EID Historical Park Concept Plan subject to the following conditions noted in the report with the exception of proposed condition "H": This permit is being granted only for the development specified under the Conditions of Development, and only on lands legally described as NE 19-15-15 W4. Any additional development shall require prior approval of a separate permit application %r The proposed development complying with: a) The provisions pertaining to the Public Service District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is responsibility of the developer to obtain all permits from an accredited inspection agency. Reasons for Approval The Municipal Planning Commission has approved DP #3569 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Public Service District (Schedule 2), and Standards of Development (Schedule 4), as specified in the County of Newell Land Use Bylaw #1626-07. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Subject to the following condtions a) That this development is provided as shown on the site plan approved in this application and submitted January 9, 2012. Any changes to that plan shall require the written approval of the Development Officer. February 9,2012 Municipal Planning Commission Page 3 b) The following existing development items are included under this permit: i) Lawnmower/ tool shed (southwest of 1) " ► ii) Equipment shed (item 2) iii) Equipment building (item 3) iv) Bow River Ferry display (item 4) v) Bow Slopes Stock Yard (item 6) - this structure is for display purposes only; no animals will be permitted to use the structure vi) Puffer Pete's (item 7) vii) Outdoor equipment display (item 9) viii) Caretaker residence (item 11) ix) Lutheran church (item 13) x) General store (item 14) xi) Blacksmith shop (item 15) xii) Barn (item 16) xiii) Original Campground Washroom and Cookshack (19) xiv) Windmill (22) xv) EID Historical Park sign (over entrance to site) c) The following new development items are included under this permit: i) RV park and campground: the creation of 15 additional fire pits / campsites. On the site plan, these are shown as numbers 22 to 37 ii) On-site signage: the placement of 2 signs (8 ft x 16 ft) to direct tourist traffic on the site iii) Kristensen house (12) approx. 400 ft2 iv) Pole Shed - outdoor storage for household and farming artefacts - pole shed (17) 4900 ft2 v) Coal Mine residence (18) approx. 400 ft2 vi) Boardwalk (20) vii) Line shack (21) approx. 150 ft2 d) The following items are not included under this permit: i) Any signage advertising the EID Historical Park that is to be placed off site ii) Provision of food and beverage services to visitors (from plan) - this facility will require a separate permit because of food safety requirements e) That there is a 2 m (6.6 ft.) separation distance between any new buildings and any other buildings or structures on the site. f) That access can be provided for Emergency Services vehicles to all sides of the buildings. g) No buildings/structures on the site may be used for living purposes, with the exception of the Caretaker residence. h) One shipping container will be permitted on the site. i) That the following setbacks on all sides are maintained for this development: Front and Side: n/a Rear (Railway Ave): 20 ft (6.1 m) j) The EID Historical Society must review this permit with the Development Officer in November 2017 to determine which of the new development items approved through this permit have been completed and whether a new permit will be required.
