CALL TO ORDER The Chairman called the meeting to order at 10:01 a.m. 2. EXCUSED FROM MEETING There were no members excused from the meeting. 3. MINUTES a) April 19, 2012 P-26/12 MOVED BY COUNCILLOR B. DEJONG that the minutes of the April 19, 2012 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-27/12 MOVED BY COUNCILLOR I. SCHROEDER that the agenda be adopted as presented. MOTION CARRIED 6. S.D.A.B. REPORT a) DP 3575- Old Mennonite Church The Manager of Planning and Development provided information regarding the Appeal Board decision. M.P.C. discussed the response from Public Works regarding the roads on the initial application. The Manager of Planning and Development responded that Public Works had no issue with the roads at the time. 7. DEVELOPMENT REPORT APRIL 1-30, 2012 P-28/12 MOVED BY COUNCILLOR A. EASTMAN that the Development Report be adopted as presented. MOTION CARRIED 8. SUBDIVISIONS a) 2012-0-053 - NE 6-22-18-W4M, Division 6 422403 Alberta Ltd. (Owner) / (Applicant) To create one (1) new parcel approximately 8.48 acres (3.43 ha) in size, containing an existing farmstead, from an unsubdivided quarter section for residential use. The County Planner provided background information on the proposed subdivision. P-29/12 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning Commission APPROVE subdivision #2012-0-053, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant or owner submit to the Subdivision Authority a copy of a sketch from an Alberta Land Surveyor that certifies the location and dimensions of the existing buildings, the location of the septic field and well, and the exact dimensions of the lot to be subdivided. DEVELOPMENT PERMITS a) Permit #3572- SW 10-15-15 W4M, Division 4 Wayne Slenders (Owner) / (Applicant) Installation of a manufactured dwelling, older than 20 years old. The Manager of Planning and Development provided background information on the proposed development permit. Discussion followed regarding the consistency with bringing in manufactured homes that are over 20 years old and taking a deposit. There were questions about the Land Use Bylaw and what the protocol is for approving this permit. The M.P.C. expressed concern about who would follow up on this approval in three years and what would be done to remove the dwelling if the landowner doesn't follow his permit conditions. The Manager of Planning and Development responded that she would follow up and would put a stop order on the land if the conditions weren't followed. P-30/12 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning Commission APPROVE Development Permit #3572 for the installation of a manufactured dwelling subject to the following conditions: This is a 3-year temporary permit, being granted only for the installation of an approximately 1000 ft2 (93 m2) 1975 manufactured dwelling on lands legally described as SW 10-15-15 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is responsibility of the developer to obtain all permits from an accredited inspection agency. Reasons for Approval 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2), Standards of Development (Schedule 4) and Development Standards for Manufactured, Mobile, Modular, Ready-to-Move (RTM) Homes. (Schedule 9), as specified in the County of Newell Land Use Bylaw #1626-07. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Subject to the following conditions a) That this development is located as shown on the site plan approved in this application and submitted January 27, 2012. Any changes to that plan shall require the written approval of the Development Officer. b) That the following setbacks on all sides are maintained for this development: May 10,2012 Municipal Planning Commission Page 3 Front (west): 100 ft (30 m) c) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. Nitfto d) That the developer must remove the dwelling by May 31 , 2015. MOTION CARRIED b) Permit #3599 - NW 19-21-18 W4M, Division 6 Lorne & Sherry Steinbach / Lorne S. Farms (Owner) / (Applicant) Construction of an oversize accessory building (shop) in the Urban Fringe. The Manager of Planning and Development provided background information on the proposed development permit. There was discussion among M.P.C. regarding the dimensions of a regular accessory building as opposed to oversize. The Manager of Planning and Development responded that a regular size accessory building is 3200 square feet and the Administrator added that typically a farmer would have land zoned agriculture and they are not limited on size for accessory building. P-31/12 MOVED BY COUNCILLOR L. MSS that the Municipal Planning Commission APPROVE Development Permit #3599 for the construction of an oversize accessory building and subject to the following conditions: This permit is being granted only for the construction of a 6000 ft2 (557.4 m2) accessory building (shop) in the Urban Fringe area of the Town of Bassano, on lands legally described as NW 19-21-18 W4M. Any additional development shall require prior approval of a separate permit application The proposed development complying with: a) The provisions pertaining to the Urban Fringe District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes, where applicable. If the developer is required to obtain a building permit, it is his / her responsibility to obtain this permit from an accredited inspection agency. d) All Alberta Safety Codes, where applicable. If the developer is installing a sewage disposal system, the Private Sewage Disposal System Permit must be issued by an accredited inspection agency. e) Any other required permits, including electrical, heating & ventilation, gas and/or plumbing. All permits must be issued by a licensed agency. The proposed development complying with: f) The provisions pertaining to the Urban Fringe District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. g) All Federal, Provincial and Municipal statutes, regulations, codes and standards. h) All Alberta Building Codes and Safety Codes, where applicable. i) It is responsibility of the developer to obtain all permits from an accredited inspection agency. May 10,2012 Municipal Planning Commission Page 4 The Municipal Planning Commission has approved DP #3487 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw #1626-07. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Subject to the following conditions a) That this development is located as shown on the site plan approved in this application and submitted April 20, 2012. Any changes to that plan shall require the written approval of the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That there is a 2 m (6.6 ft.) separation distance between the new building and any proposed accessory buildings. d) That the proposed accessory building is not used for living purposes. e) The developer must start construction before May 22, 2013 and be completed by May 22, 2014. In the event that either of these dates are not met, the developer may be required to apply for a new permit. f) That the following setbacks on all sides are maintained for this development: Front (TR 21-4, north): 100 ft (30 m) Side: n/a Rear: n/a MOTION CARRIED 10. The Assistant Administrator responded that there will be a meeting to discuss the matter on May 17, 2012 and the County of Newell is suggesting that it be concluded as discussed. 14.
