MINUTES a) May 10, 2012 P-32/12 MOVED BY COUNCILLOR I. SCHROEDER that the minutes of the May 10, 2012 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-33/12 MOVED BY COUNCILLOR A. EASTMAN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS a) Permit #3594 - Lot 1, Block 1, Plan 1210774, SW 27-18-14 W4M, Division 5 H & L Traichel / Vortex Sandblasting (Owner) / (Applicant) Construction of a paint shop The Manager of Planning and Development provided background information on the proposed development permit. P-34/12 MOVED BY COUNCILLOR L. MSS that the Municipal Planning Commission APPROVE Development Permit #3594 for the construction of a paint shop subject to the following conditions: This permit is being granted only to construct a 3000 ft2 (2787 m2) paint shop, on lands legally described as Lot 1, Block 1, Plan 121 0774, SW 27-18-14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Light Industrial District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is the responsibility of the developer to obtain all permits from an accredited inspection agency. Reasons for Approval The Municipal Planning Commission has approved DP #3594 for the following reasons: 1. The proposed development complies with both the Municipal Development Plan and the Intermunicipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Light Industrial District (Schedule 2) and Standards of Development (Schedule 4), as specified in the County of Newell Land Use Bylaw #1626-07. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Subject to the following conditions a) That this development is located as shown on the site plan approved in this application and submitted April 17, 2012. Any May 24,2012 ��� Municipal Planning Commission Page 2 cU changes to that plan shall require the written approval of the Development Officer. b) That there is a 2 m (6.6 ft.) separation distance between the accessory building (paint shop) and any other existing building. c) That the proposed accessory building (paint shop) is not used for living purposes. d) The developer must start construction before June 5, 2013 and be completed by June 5, 2014. In the event that either of these dates are not met, the developer may be required to apply for a new permit. e) That the following setbacks on all sides are maintained for this development: Front (Hwy 1A): 100 ft (30 m) Side (east and west): 10 ft (3 m) Rear (south): 20 ft (6 m) MOTION CARRIED b) Permit #3600 - Lot 20, Block 2, Plan 0411757, NW 20-21-18 W4M, Division 6 Paul Kaupp (Owner) / (Applicant) Aircraft Hangar at Bassano Airport The Manager of Planning and Development provided background information on the proposed development permit. There were concerns from M.P.C. regarding the use of the pilot's quarters and lounge area. The Manager of Planning and Development responded that the lounge would only be for resting purposes. If it were used in the future for sleeping, then the permit and zoning would have to be revisited. There were questions regarding the size of the hanger as noted in the report. The Manager of Planning and Development responded that she would clarify the building size with the landowner. P-35/12 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning Commission APPROVE Development Permit #3600 for an aircraft hangar at the Bassano Airport subject to the following conditions: This permit is being granted only for the construction of a 4800 ft2 (446 m2) aircraft hangar on lands legally described as Lot 20, Block 2, Plan 041 1757, NW 20-21-18 W4. Any additional development shall require prior approval of a separate permit application The proposed development complying with: a) The provisions pertaining to the Public Service District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is the responsibility of the developer to obtain all permits from an accredited inspection agency. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Public Service District (Schedule 2), and Standards of Development (Schedule 4), as specified in the County of Newell Land Use Bylaw #1626-07. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Subject to the following conditions a) That this development is provided as shown on the site plan approved in this application and submitted April 23, 2012. Any changes to that plan shall require the written approval of the Development Officer. b) That access can be provided for Emergency Services vehicles to all sides of the buildings. c) That the property is not used to conduct business or commercial operation unrelated to airport operations. d) That the property is not used for storage unrelated to airport operations. e) That the aircraft hangar is not used for living purposes. f) That the following setbacks on all sides are maintained for this development: Front and Rear (east and west): 20 ft (6 m) Side (north and south): 10 ft (3 m) g) That construction of the hangar is completed within a 12-month period, as stipulated in the letter from the Town of Bassano, by June 5, 2013. In the event that this date is not met, the developer may be required to apply for a new permit. P-36/12 MOVED BY COUNCILLOR B. DEJONG that Motion P-35/12 be TABLED. MOTION CARRIED RECESS The Municipal Planning Commission meeting RECESSED at 10:18 a.m. and RECONVENED at 10:27 a.m. P-37/12 MOVED BY COUNCILLOR I. SCHROEDER that Motion P-35/12 be LIFTED FROM THE TABLE. MOTION CARRIED The Manager of Planning and Development provided further information and indicated that the report would be corrected. VOTE ON MOTION P-35/12 - MOTION CARRIED c) Permit #3602 - Lot 1, Block 2, Plan 0011232, NW 12-20-15 W4M, Division 8 Owen Syverson (Owner) / (Applicant) Construction of an accessory building; variance to setback requirement May 24,2012 ��1 Municipal Planning Commission Page 4 The Manager of Planning and Development provided background information on the proposed development permit. M.P.C. asked about the 100 ft. standard setback. The Manager of Planning and Development responded that the standard 100 ft setback is required by Public Works for a County road ROW. However, the setback in a Country Residential subdivision is 20ft. The distinction between a County Road and a subdivision road will be clarified in the updated land use bylaw. Councillor B. deJong stated that he looked at the parcel and that 50 ft. is an appropriate setback distance from the road as it is a dead end country road in a subdivision. P-38/12 MOVED BY COUNCILLOR B. DEJONG that the Municipal Planning Commission APPROVE Development Permit #3602 for the construction of an accessory building with a variance to setback requirement subject to the following conditions: This permit is being granted only for the installation of a 1024 ft2 (95.1 m2) accessory building with a variance to the setback requirement to the County road, on lands legally described as Lot 1, Block 2, Plan 001 1232, NW 12-20-15 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Country Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is the responsibility of the developer to obtain all permits from an accredited inspection agency. Reasons for Approval The Municipal Planning Commission has approved DP #3602 for the following reasons: The proposed development complies with the Municipal Development Plan. 1. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Country Residential District (Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw #1626-07. 2. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Subject to the following conditions a) That this development is located as shown on the site plan approved in this application and submitted April 27, 2012. Any changes to that plan shall require the written approval from the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That the developer obtain a Roadside Development Permit from Alberta Transportation. A copy of this permit must be submitted to the Development Officer. d) That the proposed accessory building (garage) is not used for living purposes. May 24,2012 Municipal Planning Commission Page 5 v r e) That the following setbacks are maintained for this development: Front (east): 50 ft (15.24 m) Variance Side (north and south): 20 ft (6 m) Rear (west): 20 ft (6 m) f) That there is a minimum 2 m (6.6 ft.) separation distance between the accessory building and any other structures. g) The developer must start construction before June 5, 2013 and be completed by June 5, 2014. In the event that either of these dates are not met, the developer may be required to apply for a new permit. MOTION CARRIED 7. POST AGENDA 8. IN CAMERA ITEMS There were no in camera items. 9.
