MUNICIPAL PLANNING COMMISSION MEETING
June 7, 2012
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, AB on Thursday, June 7, 2012 commencing at
10:01 a.m.

1. CALL TO ORDER
The Chairman called the meeting to order at 10:01 a.m.
2. EXCUSED FROM MEETING
P-39/12 MOVED BY COUNCILLOR I. SCHROEDER that Councillor Juss be excused
from the meeting.

3. MINUTES
a) May 24, 2012
P-40/12 MOVED BY COUNCILLOR M. NESBITT that the minutes of the May 24,
2012 Municipal Planning Commission meeting be adopted as presented.

4. CALL FOR POST AGENDA ITEMS
The Chairman called for post agenda items.
5. ADOPTION OF AGENDA
P-41/12 MOVED BY COUNCILLOR R. ANDREWS that the agenda be adopted as
presented.

6. DEVELOPMENT REPORT
The Manager of Planning and Development provided information on the
Development permit. She added that there was 76 construction permits
for the month of April.
P-42/12 MOVED BY COUNCILLOR M. DOUGLASS that the Development Report be
adopted as presented.

7. DEVELOPMENT PERMITS
a) Permit #3605 - SW 16-23-16W4M, Block 1, Plan 8310274,
Division 9

Installation of a 1994 Manufactured Dwelling; variance to front
setback.
The Manager of Planning and Development provided background
information on the proposed development permit. The landowner's
reason for requesting the variance is so that the septic field will not
need to be moved. There was concern from M.P.C. regarding
appearance of the manufactured home. The Manager of Planning and
Development responded that she has photos of the home and it is in
reasonable condition and will not require improvements.
P-43/12 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning
Commission APPROVE Development Permit #3605 for the installation
of a 1994 Manufactured Dwelling; variance to front setback subject to
the following conditions:
This permit is being granted only for the installation of a 960 ft2 (89
m2) 1994 manufactured dwelling, on lands legally described as Block
1, Plan 831 0274, SW 16-23-16 W4M. Any additional development
shall require prior approval of a separate permit application.

The proposed development complying with:
a) The provisions pertaining to the Agricultural District and all
relevant schedules, as outlined in the County of Newell Land Use
Bylaw #1626-07.
b) All Federal, Provincial and Municipal statutes, regulations, codes
and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.
d) It is responsibility of the developer to obtain all permits from an
accredited inspection agency.
Reasons for Approval
The Municipal Planning Commission has approved DP #3605 for the
following reasons:
1. The proposed development complies with the Municipal
Development Plan.
2. The Development Authority is satisfied that the proposed
development is suitable for the purpose for which it is intended
under the Agricultural District (Schedule 2), Development
Standards for Manufactured, Mobile, Modular and Ready-to-Move
(RTM) Homes (Schedule 9), and Standards of Development
(Schedule 4), as specified in the County of Newell Land Use Bylaw
#1626-07.
3. No objections have been received from adjacent landowners or
referral agencies with respect to the proposed development.
Subject to the following conditions
a) That this development is located as shown on the site plan
approved in this application and submitted May 7, 2012. Any
changes to that plan shall require the written approval of the
Development Officer.
t b) That the following setbacks on all sides are maintained for this
development:
Front (south): 55 ft (16 m) Variance
Side (east and west) 10 ft (3 m)
c) That the property is not used for conducting a business or
commercial operation without first obtaining the required permits.
d) The developer must begin installation before June 19, 2013 and
be completed by June 19, 2014. In the event that either of these
dates cannot be met, the developer may be required to apply for
a new permit.

8. OTHER BUSINESS
a) Single Lot Agriculture Use
The County Planner provided information about the proposed Single
Lot Agriculture District in the new Land Use Bylaw. She indicated that
the intention of the land use district is to provide rules for subdividing
a third parcel from a quarter, so that any further subdivision of that
parcel will require additional review prior to approval. MPC asked
questions and discussed the purpose and size of the parcel that could
be created under the district. There was also discussion about
whether the maximum size of the parcel should be increased from 5
to 7 acres.

Councillor C. AMULUNG
The County Planner indicated that she will add this discussion to her
report that will be presented to MPC in a future meeting regarding the
information that has been collected from the public open house and
stakeholder meetings.
