CALL TO ORDER The Chairman called the meeting to order at 10:04 a.m. 2. EXCUSED FROM MEETING All members were present. 3. MINUTES a) June 21, 2012 P -/12 MOVED BY COUNCILLOR M.NESBITT that the minutes of the June 21, 2012 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P -/12 MOVED BY COUNCILLOR R. ANDREWS that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORTS P -/12 MOVED BY COUNCILLOR I.SCHROEDER that the Development reports be adopted as presented. MOTION CARRIED 7. DEVELOPMENT PERMITS a) Permit #3612 - Lot 1, Block 3, Plan 111 3418 SE 12 -20 -15 W4M, Division 8 Steve & Debra Kowal (Owner /Applicant) Installation of manufactured dwelling The Assistant Administrator provided background information on the proposed development permit. MPC was concerned about security deposits, MPC questioned protocol if improvements were not done. The Assistant Administrator responded that the money would be put towards the stop order if improvements were not done and if there were any additional costs those would be attached to the Tax Roll. P -/12 MOVED BY COUNCILLOR B. DEJONG that the Municipal Planning Commission APPROVE Development Permit #3612 for installation of manufactured dwelling subject to the following conditions: This permit is being granted only for the installation of a 1008 ft2 (93.6 m2) 1980 manufactured dwelling, on lands legally described as Lot 1, Block 3, Plan 111 3418, SE 12 -20 -15 W4M. Any additional development shall require prior approval of a separate permit application. July 5, 2012 The proposed development complying with: a) The provisions pertaining to the Country Residential District and all Municipal Planning Commission Page 2 July 5, 2012 relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626 -07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is responsibility of the developer to obtain all permits from an accredited inspection agency. Reasons for Approval The Municipal Planning Commission has approved DP #3612 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Country Residential District (Schedule 2), Standards of Development (Schedule 4), and Development Standards for Manufactured, Mobile, Modular, Ready -to -Move (RTM) Homes (Schedule 9), as specified in the County of Newell Land Use Bylaw #1626 -07. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted June 5, 2012. Any changes to that plan shall require the written approval from the Development Officer. b) That the developer provide the County of Newell with a security deposit, in the amount of $2500.00 to ensure that the requirements of the following conditions are met: i) the improvements are completed as specified in the application, including the replacement of the 2 windows, door, and siding of the manufactured dwelling, within two years from the date of approval. c) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. d) That the following setbacks are maintained for this development: Front (east): 100 ft (15.24 m) Side (north and south): 20 ft (6 m) Rear (west): 20 ft (6 m) e) That there is a minimum 2 m (6.6 ft.) separation distance between this dwelling and any other structures. f) The developer must start construction before July 17, 2013 and be completed by July 17, 2014. In the event that either of these dates are not met, the developer may be required to apply for a new permit. MOTION CARRIED b) Permit #3606 — NW- 31- 20- 14 -W4M, Division 8 Liberty Trucking (Owner /Applicant) Update to Development of a Commercial Storage Area Municipal Planning Commission Page 3 The Assistant Administrator provided background information on this matter which was the subject of a discussion that arose during the June 21 M.P.C. meeting. It was noted that as a result of the information provided in the update report, no further action of reconsideration of an earlier decision was required for this file. 8. POST AGENDA 9.
