July 19, 2012
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, AB on Thursday, July 19, 2012 commencing at
10:00 a.m.

The County Planner provided background information on the proposed
subdivision.
Clarification was requested regarding an area on the map provided. The
County Planner said that is was a separate title and is being consolidated
with the adjacent title
P -59/12 MOVED BY COUNCILLOR M. NESBITT that the Municipal Planning
Commission APPROVE subdivision #2012 -0 -121, subject to the following
conditions:
1. That all outstanding property taxes shall be paid to the County of
Newell.
2. That the subdivided portion of Certificate of Title 051 244 952 (Lot 1,
Block 3, Plan 0511247 within N 1/2 23 -20 -14 -W4M) be consolidated with
the adjacent parcel legally known as Lot 1, Block 2, Plan 0512476 within
SE 1/4 26 -20 -14 -W4M in a manner such that the resulting Certificate of
Title could not be subdivided without the approval of the Subdivision
Authority.

To create five parcels ranging in size from 9.0 acres to 20.0 acres from
an existing of 67.68 acres for Country Residential.
The County Planner provided background information on the proposed
subdivision.
Question was raised regarding deferral of the 10% municipal reserve
required and whether it can be tracked? The County Planner replied that
it can and if handled in this manner, it could benefit the Village of
Duchess if the property is ever annexed into the Village. MPC member
expressed concern that drainage issue was not addressed. The County
Planner said that one of the conditions was that a qualified engineer
prepare a formal drainage plan for the property.
P -60/12 MOVED BY COUNCILLOR B. DE]ONG that the Municipal Planning
Commission APPROVE subdivision #2012 -0 -060, subject to the following
conditions:
1. That all outstanding property taxes shall be paid to the County of
Newell.
2. That, pursuant to Section 655(1)(b) of the Municipal Government Act,
the applicant or owner or both enter into a Development Agreement with
the Count of Newell which shall be registered concurrently with the final
plan against the title(s) being created.
3. That an engineered drainage /storm water management plan be prepared
by a qualified engineering professional and submitted and deemed
acceptable by the Subdivision Authority.
4. That the easement(s) as required by ATCO GAS or any other utility
agency of the municipality shall be established prior to finalization of the
application and are to be registered simultaneously with the legal plan of
the subdivision

T. Preston, agent, appeared and made a verbal presentation to the council
for MPC approval of an 8 foot wooden fence surrounding the property. MPC
was concerned with:
1. snow removal and dust control
2. maintenance, aesthetics and repair of fence
T. Preston said that snow removal has been discussed with the County of
Newell and the fence would be painted and kept in repair and with the fence
being wood and 8 feet high the dust issue would be controlled.
MOVED BY COUNCILLOR C. AMULUNG that the Municipal Planning
Commission APPROVE Development Permit #3625 for construction of a
fence subject to the following conditions:
This permit is being granted only to construct an 8 ft (2.4 m) wood fence on the
perimeter of lands legally described as Lot 1, Block 1, Plan 121 0774, SW 27 -18 -14
W4M. Any additional development shall require prior approval of a separate permit
application.
The proposed development complying with:
a) The provisions pertaining to the Light Industrial District and all relevant schedules,
as outlined in the County of Newell Land Use Bylaw #1626 -07.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.
d) It is responsibility of the developer to obtain all permits from an accredited
inspection agency.
Reasons for Approval
The Municipal Planning Commission has approved DP #3625 for the following reasons:
1) The proposed development complies with both the Municipal Development Plan
and the Intermunicipal Development Plan.
2) The Development Authority is satisfied that the proposed development is suitable
for the purpose for which it is intended under the Light Industrial District (Schedule
2) and Standards of Development (Schedule 4), as specified in the County of
Newell Land Use Bylaw #1626 -07.
3) No objections have been received from adjacent landowners or referral agencies
with respect to the proposed development.
Subject to the following conditions
a) That this development is located as shown on the site plan approved in this
application and submitted June 27, 2012. Any changes to that plan shall require
the written approval of the Development Officer.
b) That the height of the fence being constructed for this development shall not exceed
8 ft (2.4 m).

Construction of a solar array facility
The Manager of Planning and Development provided background
information on the proposed development permit.
I. Rogers with GTE Solar gave a visual presentation that showed what the
solar farm will look like. MPC members raised concerns about the following:
1. glare from the panels
2. maintenance of the property
3. easement for the Eastern Irrigation drainage ditch
4. when the project will be completed
I. Rogers responded there will be minimum glare that would not interfere
with anything. He stated the area around the panels will be graveled and a
low fescue grass will be planted on the rest of the property which will be
mowed on a regular basis. He explained that the majority of the panels will
be installed using screw piles with the cabling either above or below ground
and stated they would make sure they satisfied the required easement
requested by the Eastern Irrigation District. I. Rogers replied that they
should have 1 megawatt of power up and running by the end of 2012 with
the balance completed and on grid by the spring of 2013.

APPROVE Development Permit #3616 for the construction of a solar array
facility, and subject to the following conditions:
This permit is being granted only to provide approval for the construction of a solar
array facility, on lands legally described as SW 3 -19 -14 W4M. Any additional
development shall require prior approval of a separate permit application.
The proposed development complying with:
a) The provisions pertaining to the Industrial District and all relevant schedules, as
outlined in the County of Newell Land Use Bylaw #1626 -07.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.
d) It is responsibility of the developer to obtain all permits from an accredited
inspection agency.
Reasons for Approval
The Municipal Planning Commission has approved DP #3616 for the following reasons:
a) The proposed development complies with both the Municipal Development Plan
and the Intermunicipal Development Plan.
b) The Development Authority is satisfied that the proposed development is suitable
for the purpose for which it is intended under the Industrial District (Schedule 2),
Standards of Development (Schedule 4), as specified in the County of Newell Land
Use Bylaw #1626 -07.

Conditions of Development
a) That this development is located as shown on the site plan approved in this
application and submitted June 13, 2012. Any changes to that plan shall require
the written approval of the Development Officer.
b) That no building or structure involved with the solar array facility is used for living
purposes.
c) This permit applies to the following development on the site:
i. Each solar array (table) is 4 panels wide (2 m wide each) for a total width of
8 m. The arrays are 6 panels high (1 m high per panel) for a total height of 6
m. Since each panel is sloped at 45 degrees, the actual land occupied for
the width is 4.2 m. The total area taken up by each array is 33.6 m2. There
are 160 arrays for each 1 megaWatt bank in 15 banks, for a total of 2400
arrays.
ii. A 430 ft2 (40 m2) site controller building will be located near the north
entrance gate.
iii. Each Inverter/Transformer Platform will be 258 ft2 (24 m2); 15 platforms will
total 3875 ft2 (360 m2).
d) That the developer obtain a Roadside Development Permit from Alberta
Transportation. A copy of this permit must be submitted to the Development Officer.
e) That access can be provided for Emergency Services vehicles to all sides of the
site controller building. Furthermore, the developer must provide an Emergency
Response Plan, to the satisfaction of the County Fire and Emergency Services
Coordinator, prior to starting up operations.
f) That the setbacks on the site are retained as per the attached site plan.
g) The developer must start construction before July 31, 2013 and be completed by
July 31, 2014. In the event that these dates cannot be met, the developer may be
required to apply for a new permit.

The Manager of Planning and Development provided background
information on the proposed development permit.
P -63/12 MOVED BY COUNCILLOR A.M. PHILIPSEN that the Municipal Planning
Commission APPROVE Development Permit #3624 for the installation of a
2012 Manufactured Dwelling, and subject to the following conditions:
This permit is being granted only for the installation of a 1520 ft2 (141.2 m2) 2012
manufactured dwelling, on lands legally described as Lot 13, Block 2, Plan 781 1389,

NE 19 -15 -15 W4M. Any additional development shall require prior approval of a
separate permit application.
The proposed development complying with:
a) The provisions pertaining to the Hamlet Residential District and all relevant
schedules, as outlined in the County of Newell Land Use Bylaw #1626 -07.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.
d) It is responsibility of the developer to obtain all permits from an accredited
inspection agency.
Reasons for Approval
The Municipal Planning Commission has approved DP #3624 for the following reasons:
1. The proposed development complies with the Municipal Development Plan.
2. The Development Authority is satisfied that the proposed development is suitable
for the purpose for which it is intended under the Hamlet Residential District
(Schedule 2), Standards of Development (Schedule 4) and Development Standards
for Mobile Homes within Hamlets, as specified in the County of Newell Land Use
Bylaw #1626 -07.
3. No objections have been received from adjacent landowners or referral agencies
with respect to the proposed development.
Conditions of Development
a) That this development is located as shown on the site plan approved in this
application and submitted June 26, 2012. Any changes to that plan shall require the
written approval from the Development Officer.
b) That the property is not used for conducting a business or commercial operation
without first obtaining the required permits.
c) That the following setbacks are maintained for this development:
Front (east):
Side (north and south):
Rear (west):
20 ft (6 m)
5 ft (1.5 m)
20 ft (6 m)
d) That there is a minimum 2 m (6.6 ft.) separation distance between the
manufactured dwelling and any other structures.
e) The developer must start construction before July 31, 2013 and be completed by
July 31, 2014. In the event that either of these dates are not met, the developer may
be required to apply for a new permit.

MPC members questioned if there were any problems with drainage.
The Manager of Planning and Development stated that to her
knowledge there were none.

P -64/12 MOVED BY COUNCILLOR A.M. PHILIPSEN that the Municipal Planning
Commission APPROVE Development Permit #3626 for the installation of a
2012 Manufactured Dwelling, and subject to the following conditions:
This permit is being granted only for the installation of a 1672 ft2 (155.3 m2) 2012
manufactured dwellings, on lands legally described as Lot 3, Block 2, Plan 951 2204,
SW 10 -19 -14 W4M. Any additional development shall require prior approval of a
separate permit application.
The proposed development complying with:
a) The provisions pertaining to the Country Residential District and all relevant
schedules, as outlined in the County of Newell Land Use Bylaw #1626 -07.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.
d) It is responsibility of the developer to obtain all permits from an accredited
inspection agency.

3. No objections have been received from adjacent landowners or referral agencies
with respect to the proposed development.
Conditions of Development
a) That this development is located as shown on the site plan approved in this
application and submitted June 28, 2012. Any changes to that plan shall require the
written approval from the Development Officer.
b) That the property is not used for conducting a business or commercial operation
without first obtaining the required permits.
c) That the following setbacks are maintained for this development:
Front and Rear (east and west): 20 ft (6 m)
Side (north and south): 20 ft (6 m)
d) That there is a minimum 2 m (6.6 ft.) separation distance between the dwelling and
any other structures.
e) The developer must start construction before July 31, 2013 and be completed by
July 31, 2014. In the event that either of these dates are not met, the developer may
be required to apply for a new permit.

information on the proposed development permit.
MPC member questioned why there was an issue, and whether the
applicant was selling. The Manager of Planning and Development stated the
applicant was. MPC members suggested that maybe something should be
put in the newsletter to let landowners know of policies concerning number
of buildings allowed on property.
P -65/12 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning
Commission APPROVE Development Permit #3627, which provides compliance for
the non - compliant accessory buildings on the site, and with a variance to the number of
accessory buildings requiring a permit, and subject to the conditions listed below.
This permit is being granted only for compliance for the existing accessory buildings
indicated on the attached Real Property Report: a 253 ft2 (23.5 m2) garage, a 125 ft2
(11.6 m2) shed and a 212 ft2 (19.7 m2) shed, and a variance to the number of
accessory buildings allowed on a Country Residential parcel, and a variance to the
separation distance between the accessory buildings, on lands legally described as Lot
2, Block 1, Plan 811 1352, SE 5 -19 -15 W4M. Any additional development shall require
prior approval of a separate permit application.
The proposed development complying with:
a) The provisions pertaining to the Country Residential District and all relevant
schedules, as outlined in the County of Newell Land Use Bylaw #1626 -07.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
c) All Alberta Building Codes and Safety Codes, where applicable.
d) It is responsibility of the developer to obtain all permits from an accredited
inspection agency.
