CALL TO ORDER The Chairman called the meeting to order at 10:00 a.m. 2. EXCUSED FROM MEETING P-81/12 MOVED BY COUNCILLOR B. DE .TONG that Councillor A.M. Philipsen and M. Douglass be excused from the meeting. MOTION CARRIED 3. MINUTES a) September 6, 2012 Arrived at meeting at 10:02 am Manager of Planning and Development, A. Wickert C P-82/12 MOVED BY COUNCILLOR M. Nesbitt that the minutes of the September 6, 2012 Municipal Planning Commission meeting be adopted as amended. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS There were no Post Agenda Items. 5. ADOPTION OF AGENDA P-83/12 MOVED BY COUNCILLOR L. JOSS that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Manager of Planning and Development provided information regarding the Development permit report. B. de Jong inquired about the Permits for this current month. The Manager of Planning and Development indicated their location. P-84/12 MOVED BY COUNCILLOR B. DE JONG that the Development Report be adopted as presented. CONSTRUCTION PERMIT REPORT The Manager of Planning and Development provided information on construction permits that have been issued by the County between January and September 2012. L. Juss inquired if an irrigation pump move requires a Permit. The Manager of Planning and Development replied that it likely did, but would check with the Development Clerk to be sure. SUBDIVISIONS October 11,2012 Municipal Planning Commission iNklkl\, Page 2 a) #2012-0-165 - SW 2-15-13-W4M Klaas F. Amulung (Owner/Applicant) To create one (1) new parcel approximately 3.01 acres (1.22 ha) in size, containing an existing farmstead, from an unsubdivided quarter section for residential use. The County Planner provided background information on the proposed subdivision. It was noted that Councillor C. Amulung was not in attendance due to his ownership interest in this property. P-86/12 MOVED BY COUNCILLOR L. 7USS that the Municipal Planning Commission APPROVE subdivision #2012-0-165, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant submit to the Subdivision Authority a copy of a sketch from an Alberta Land Surveyor that certifies the location and dimensions to property of the existing buildings, septic tank and field, water source, and the exact dimension of the lot to be subdivided. 3. That the applicant obtains a Roadside Development Permit from Alberta Transportation for the removal of one access from Highway 525 to the residual agricultural parcel and that a copy of the permit be submitted to the Subdivision Authority. The applicant should contact Alberta Transportation to finalize this condition. MOTION CARRIED Arrived at meeting at 10:09 Councillor C. Amulung Left Meeting at 10:09 Councillor I. Schroeder declared a pecuniary interest due to his ownership of SE 7- 15-13W4M and E1/2 2-17-13-W4M. b) #2012-0-166 - SE 7-15-13-W4M Saiobain Schroeder/Ike Schroeder (Owner/Applicant) To create one (1) new parcel approximately 2.68 acres (1.08 ha) in size, containing an existing farmstead, from an unsubdivided quarter section for residential use. The County Planner provided background information on the proposed subdivision. C. Amulung inquired about Alberta Transport requesting the removal of one access and the complications that would arise. The County Planner responded that she would provide a contact number with Alberta Transportation so he could speak with a representative. P-87/12 MOVED BY COUNCILLOR C. AMULUNG that the Municipal Planning Commission APPROVE subdivision #2012-0-166, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant submit to the Subdivision Authority a copy of a sketch from an Alberta Land Surveyor that certifies the location and dimensions October 11,2012 Municipal Planning Commission (Q Page 3 to property of the existing buildings, septic tank and field, water source, and the exact dimension of the lot to be subdivided. 3. MOTION CARRIED c) #2012-0-168 - E1/2 2-17-13-W4M Isaak & Eileen Schroeder (Owner/Applicant) To reconfigure two titles which would include subdividing a parcel containing an existing farmstead (approximately 11.39 acres (4.61 ha) in size), and consolidating the residual parcel with the adjacent agricultural lands to the south to create one new agricultural parcel approximately 54.54 acres (22.1 ha) in size. The County Planner provided background information on the proposed subdivision. The County Planner recommended that requirement number 2 should be stricken from the list of conditions as it is not required for this application. P-88/12 MOVED BY COUNCILLOR C. AMULUNG that the Municipal Planning Commission APPROVE subdivision #2012-0-168, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 3. That the submit to the Subdivision Authority a copy of a sketch from an Alberta Land Surveyor that certifies the location and dimensions to property of the existing buildings, septic tank and field, water source, and the exact dimension of the lot to be subdivided. 4. That the residual portion of NW 1/4 2-17-34 W4M be consolidated with the adjacent parcels legally known as portions of the SW and SE 1/4 17- 34 W4M in a manner such that the resulting Certificate of Title could not be subdivided without the approval of the Subdivision Authority. AGRICULTURAL SUPPORT SERVICE & HOME OCCUPATION PERMITS a) HO 266 - NE 1-20-4-W4M Paul and Christie Waldner (Owner/Applicant) Fencing Business The Manager of Planning and Development provided background information on the proposed development permit. B. de Jong inquired about the access to the shop as indicated on the application. The Manager of Planning and Development responded that October 11,2012 Municipal Planning Commission 1z Page 4 the applicant is responsible for providing internal access, through the trees if necessary. P-89/12 MOVED BY COUNCILLOR B. DE TONG that the Municipal Planning Commission APPROVE Home Occupation #266 for a Fencing Business subject to the following conditions: This permanent permit is being granted only for the fencing business, located on lands legally described as Lot 1, Block 1, Plan 021 1802, NE 1-20-14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is responsibility of the developer to obtain all permits from an accredited inspection agency. The Municipal Planning Commission has approved HO 266 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed ® development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2), Standards of Development (Schedule 4) and Home Occupation and Agricultural Support Services (Schedule 13), as specified in the County of Newell Land Use Bylaw #1626-07. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development: a) That this development is located as shown on the site plan approved in this application and submitted September 11, 2012. Any changes to that plan shall require the written approval from the Development Officer. b) That there are no more than 1 resident employee and 2 non- resident employees involved in the operation of this business. c) That the only advertising being permitted on the property be limited to one indirectly illuminated sign of 4 ft2 (0.4 m2) placed flat against the building or fence. DEVELOPMENT PERMITS a) Permit #3653 - Block 1, Plan 931 1397, SE 15-18-14 W4M, Division 5 Loren Mitchell (Owner/ Applicant) Compliance for existing shop October 11,2012 Municipal Planning Commission Page 5 p#Ck • The Manager of Planning and Development provided background information on the proposed development permit. The Manager of Planning and Development indicated that L. Mitchell was in attendance to answer questions. B. de Jong asked whether the shop met set back requirements as it appeared to be very close to property line. The Manager of Planning and Development replied that the shop met setbacks as required in the Agricultural Land Use District. P-90/12 MOVED BY COUNCILLOR M. NESBITT that the Municipal Planning Commission APPROVE Development Permit #3653 for compliance for an existing shop subject to the following conditions: This permit is being granted only to provide compliance for an existing 4800 ft2 (446 m2) shop on lands legally described as Block 1, Plan 931 1397, SE 15-18-14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is responsibility of the developer to obtain all permits from an ® accredited inspection agency. The Municipal Planning Commission has approved DP #3653 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2), and Standards of Development (Schedule 4), as specified in the County of Newell Land Use Bylaw #1626-07. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development: a) That this development is located as shown on the site plan approved in this application and submitted September 21, 2012. Mitchell b) Permit #3654 - Lot 1, Block 14, Plan 791 0924, NE 13-20-13 W4M, Division 3 James Bukovec &Janine Pocock/Kerry Weiland (Owner/Applicant) Install Manufactured Dwelling The Manager of Planning and Development provided background information on the proposed development permit. The Manager of Planning and Development noted that the area map was missing from the agenda. She commented that a deposit of $2500.00 to $5000.00 would not be required for this application, as the building does not require improvements. B. de Jong stated that the MPC should be consistent with security deposits for this type of application and require a deposit for all such applications. I. Schroeder indicated that his motion would stand, with no revision. P-91/12 MOVED BY COUNCILLOR I. SCHROEDER that the Municipal Planning Commission APPROVE Development Permit #3654 for the installation of a Manufactured Dwelling, and subject to the following conditions: This permit is being granted only for the installation of a 1216 ft2 (113 m2) manufactured dwelling with an existing 540 ft2 (50 m2) attached deck, on lands legally described as Lot 1, Block 14, Plan 791 0924, NE 13-20-13 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Hamlet Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. d) It is responsibility of the developer to obtain all permits from an accredited inspection agency. The Municipal Planning Commission has approved DP #3654 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Hamlet Residential District (Schedule 2), Standards of Development (Schedule 4) and Development Standards for Mobile Homes within Hamlets (Schedule 8), as specified in the County of Newell Land Use Bylaw #1626-07. Conditions of Development: a) That this development is located as shown on the site plan approved in this application and submitted Sept 28, 2012. Any changes to that plan shall require the written approval from the Development Officer. October 11,2012 Municipal Planning Commission Page 7 b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That the manufactured home is skirted with materials the same as or consistent with the remainder of the building. d) That the following setbacks are maintained for this development: Front (north): 20 ft (6 m) Side (west): 5 ft (1.5 m) Side (east): 20 ft (6 m) Rear (south) 12 ft (4 m) - variance from 20 ft (6 m) e) That there is a minimum 2 m (6.6 ft.) separation distance between the dwelling and any other structures. f) The developer must start construction before October 30, 2013 and be completed by October 30, 2014. In the event that either of these dates are not met, the developer may be required to apply for a new permit. MOTION CARRIED 11. POST AGENDA There were no Post Agenda Items 11. INFORMATION ITEMS 12.
