Douglass, Councillor M. Nesbitt, Councillor A. Eastman, Councillor B. de Jong, Councillor J. Bulger, Councillor A.M. Philipsen, Councillor & M.P.C. Chair I. Schroeder, Councillor R. CALL TO ORDER The Chairman called the meeting to order at 9:12 a.m. 2. EXCUSED FROM MEETING P-98/12 MOVED BY COUNCILLOR M. NESBITT that Councillor's C. Amulung & L. Juss be excused from the meeting. MOTION CARRIED 3. MINUTES a) November 8, 2012 P-99/12 MOVED BY COUNCILLOR B. DE TONG that the minutes of the November 8, 2012 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-100/12 MOVED BY COUNCILLOR I. SCHROEDER that the agenda be adopted as presented. MOTION CARRIED 7. SUBDIVISIONS a) #2012-0-176 - NW 19-17-16-W4M Kevin & Sherri Halsted (Owner/Applicant) To create a 26.54 acre (10.74 ha) parcel from a title of 143.37 acres (58.0 ha). MOVED BY COUNCILLOR I. SCHROEDER that subdivision #2012-0- 176 be lifted from the table. MOTION CARRIED Arrived at meeting at 9:14 a.m. Councillor A. Eastman The County Planner provided background information on the proposed subdivision. Arrived at meeting at 9:18 a.m. Councillor R. Andrews B. De Jong commented that, as shown on the new photo, the pivot will not touch the proposed parcel. K. Halsted explained that the SE part of the proposed subdivision will be used for drainage. The north boundary of the proposed subdivision follows the existing fence line. K. Halsted wishes to accommodate the drainage area and use the existing fence line to keep the entire area in one piece. The County Planner reviewed some options for MPC to consider in making a decision about this subdivision application. One option is for MPC to waive the number of parcels permitted in the quarter section combined with a variance granted regarding the maximum size of the parcel to be subdivided. A second option is for Council to amend the current Land Use Bylaw, either to change the parcel size and the number of parcels allowed under the Single Lot Agriculture district, or add the Small Holding district back into the LUB. A discussion ensued. P-102/12 MOVED BY COUNCILLOR B. DE SONG that the Municipal Planning Commission APPROVE subdivision #2012-0-176, with a waiver to the number of parcels per quarter section and to the maximum size of the November 22,2012 Municipal Planning Commission Page 2 \\M\ parcel, (sections 3.1 and 14.9(b), Schedule 2, Agricultural - A Land Use District), and subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant submit to the Subdivision Authority a copy of a sketch from an Alberta Land Surveyor that certifies the location and dimensions of the existing buildings and the exact dimensions of the lot to be subdivided. 3. An approved sewage disposal system is required to be installed that meets or exceeds the separation distances required for private sewage disposal treatment systems, for each of the existing dwellings on the proposed parcel. MOTION CARRIED b) #2012-0-185 - NE 20-18-14-W4M Eastern Irrigation District (Owner) / Eugene Foisy c/o Brooks Asphalt & Aggregate Ltd. (Applicant) To subdivide a 9.88 ha (24.40 acre) portion of the NE 1/4 20-18-14W4M and consolidate it with the adjacent parcel to the north, Lot 1, Block 1, Plan 041 4034, to accommodate the expansion of an existing industrial use. The County Planner provided background information on the proposed subdivision. P-103/12 MOVED BY COUNCILLOR M. NESBITT that the Municipal Planning Commission APPROVE subdivision #2012-0-185, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant submit to the Subdivision Authority a copy of a sketch from an Alberta Land Surveyor that certifies the location and dimensions of the existing buildings and the exact dimensions of the lot to be subdivided. 3. That the subdivided portion the NE 1/4 20-18-14 W4M be considered with the adjacent parcel legally known as NE 1/4 20-18-14 W4M in a manner such that the resulting Certificate of Title could not be subdivided without the approval of the Subdivision Authority.
