CALL TO ORDER The Chairman called the meeting to order at 10:00 a.m. 2. EXCUSED FROM MEETING P-47/13 MOVED BY COUNCILLOR 3. BULGER that Councillor A.M. Philipsen be excused from the meeting. MOTION CARRIED 3. MINUTES a) April 25, 2013 P-48/13 MOVED BY COUNCILLOR M. NESBITT that the minutes of the April 25, 2013 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-49/13 MOVED BY COUNCILLOR I. SCHROEDER that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT a. March 1 - April 30, 2013 P-50/13 MOVED BY COUNCILLOR B. de TONG that the Development Report be adopted as presented. MOTION CARRIED 7. AGRICULTURAL SUPPORT SERVICE & HOME OCCUPATION PERMITS a) HO #271 - Lot 2, Block 2, Plan 021 1860, NW 9-12-16W4M,Division 9 Graham George (Owner/ Applicant) Machine Shop The Manager of Planning and Development provided background information on the proposed development permit. MPC was given the opportunity to ask questions. P-51/13 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning Commission APPROVE Home Occupation Permit #271 for a Machine Shop r! subject to the following conditions: This permanent permit is being granted only for the machine shop business, located on lands legally described as Lot 2, Block 2, Plan 021 1860, NW 9-23-16 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use May 9,2013 Municipal Planning Commission Page 2 Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved HO 271 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2), Standards of Development (Schedule 3) and Home Occupations (Schedule 4 Section 9), as specified in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted April 12, 2013. Any changes to that plan shall require the written approval from the Development Officer. b) That there are no more than 2 resident employees involved in the operation of this business. c) The following vehicles are permitted to be used in this business: 1 flatbed truck, 1 trailer. , d) That the only advertising being permitted on the property be limited to one indirectly illuminated sign of 32 ft2 (3 m2) placed flat against the building or fence. MOTION CARRIED 8. DEVELOPMENT PERMITS a) Permit #3704 - Lot 2, Block 2, Plan 021 18560, NW 9-23-16 W4M, Division 9 Graham George (Owner/ Applicant) Addition to an existing Quonset, variance to setback from road allowance. The Manager of Planning and Development provided background information on the proposed development permit. M. Douglass asked whether the addition would be outside of the 100 ft setback requirement. The Manager of Planning and Development replied that, while the addition will be closer than 100 ft to the road allowance, since it is also part of the variance request for the Quonset, it will also be compliant. P-52/13 MOVED BY COUNCILLOR I. SCHROEDER that the Municipal Planning Commission APPROVE Development Permit #3704 for the addition to an May 9,2013 Municipal Planning Commission 1 Page 3 existing Quonset, with variance to setback from road allowance subject to the following conditions: This permit is being granted only to provide approval for the construction of an 800 ft (74 m ) addition, with a variance to the setback to the County road allowance, on lands legally described as Lot 2, Block 2, Plan 021 1860, NW 9-23-16 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP #3704 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2), and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted April 12, 2013. Any changes to that plan shall require the written approval of the Development Officer. b) That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures. c) That the accessory building (Quonset) is not used for living purposes. d) That the following setbacks on all sides are maintained for this development: Front (east): 85 ft (26 m); variance from 100 ft (30 m) Side (north and south): 25 ft (7.6 m) Rear (west): 25 ft (7.6 m) e) The developer must start construction before May 31, 2014. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. MOTION CARRIED May 9,2013 Municipal Planning Commission Page 4 b) Permit #3707 - Lot 1, Block 1, Plan 131 0523, W 1/2 9-18-15 W4M, Division 5 Atco Electric, Barry Sullivan (Owner/ Applicant) Temporary construction yard ARRIVED AT MEETING Councillor L. ]uss arrived at 10:11 a.m. The Manager of Planning and Development provided background information on the proposed development permit. B. de Jong inquired why this permit had not been included in the previous permit for Atco Electric. The Manager of Planning and Development responded that at the time of the previous permit application, Atco Electric was not ready with the current application, and they felt waiting to apply for both parts as one application would delay the original permit application. P-53/13 MOVED BY COUNCILLOR M. NESBITT that the Municipal Planning Commission APPROVE Development Permit #3707 for the temporary construction yard, and subject to the following conditions: This permit is being granted only to provide approval for the development of the temporary construction yard at the Atco HVDC Transmission site, on lands legally described as Lot 1, Block 1, Plan 131 0523, W1/2 9-18-15 W4M. Any additional development shall require prior approval of a separate permit application. a The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety.Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP #3707 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land I' Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. !` Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted April 25, 2013. Any May 9,2013 Municipal Planning Commission Page 5 k\Ik changes to that plan shall require the written approval of the Development Officer. b) That access can be provided for Emergency Services vehicles to all areas of the site. c) That the following structures, buildings and storage areas shown on the attached site plan are approved under this permit: i) Parking area ii) 6 field offices (Atco trailers) iii) 2 washroom buildings (Atco trailers) iv) Badging building (Atco trailer) v) Communication center vi) Generator area vii) Contractor trailer area - 6200 ft2 (580 m2); up to 15 contractor trailers will be allowed in this area at any one time viii) Construction and maintenance area - 35,500 ft2 (3300 m2) ix) Construction equipment materials laydown area - 251,300 ft2 (20,000 m2) d) That none of the office trailers or any other structures on the site are used for living purposes. e) The developer must start construction before May 31, 2014. In the event that this date cannot be met, the developer must apply �? for an extension and may be required to apply for a new permit. MOTION CARRIED 9. POST AGENDA There were no post agenda items. fi 10. INFORMATION ITEMS a) NRCB Application No LA13007 Hutterian Brethren of Springview Colony M. Douglass asked if it was County of Newell policy to send out letters to adjacent landowners May 3 for a reply by May 9, 2013, which was today's date. The Manager of Planning and Development replied that the NRCB issues this type of application. NRCB had requested a list of adjacent landowners, so they could be contacted about the application. The NRCB letter was to make the County aware of the application and request information. The requested information was faxed by the Administrative Assistant well before the reply date. 11.
