CALL TO ORDER The Chairman called the meeting to order at 10:01 a.m. 2. EXCUSED FROM MEETING P-18/14 MOVED BY COUNCILLOR B. DE JONG that Councillor W. Hammergren be excused from the meeting. MOTION CARRIED 3. MINUTES a) February 20, 2014 P-19/14 MOVED BY COUNCILLOR K. CHRISTMAN that the minutes of the February 20, 2014 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-20/14 MOVED BY COUNCILLOR E. UNRUH that the agenda be adopted as presented. MOTION CARRIED 7. DEVELOPMENT REPORT a) Construction Permit Report b) Permitted Use Report The Manager of Planning & Development provided information on the Construction and Permitted Use reports. Councillor E. Unruh inquired as to what defined a Plumbing permit. The Manager of Planning & Development responded that it is any interior installation or alteration of a plumbing fixture, i.e. sink or drain. She added that a Plumbing permit should not be confused with a Private Sewage Disposal System (PSDS) permit which refers to a septic field. P-21/14 MOVED BY COUNCILLOR T. FYFE that the Development Report be adopted as presented. MOTION CARRIED 8. SUBDIVISIONS a) #2014-0-011 - Lot 1, Block 1, Plan 121 1809, NW, NE, SW 5-18-14- W4M George & Carol Perry / E.I.D. (Owner/Applicant) To consolidate portions of Lot 1 Block 1 Plan 1211809 in the NW5, a portion of NE5 for access and SE5 18-14W4M. The County Planner provided background information on the proposed subdivision. March 6,2014 Municipal Planning Commission Page 2 K°Iā€˜ Councillor K. Christman asked if the neighbouring landowners had been made aware of the application. The County Planner responded that all the adjacent landowners had been notified and no responses were received. P-22/14 MOVED BY COUNCILLOR C. AMULUNG that the Municipal Planning Commission APPROVE subdivision #2014-0-011, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant or owner or both enter into a Development Agreement with the County of Newell which shall be registered concurrently with the final plan against the title(s) being created. 3. Consolidation of that portion of Lot 1 Block 1 Plan 1211809 lying within the NW5 and 0.15 acres of NE5 with Certificate of Title 121157636+1 in a manner such that the resulting Certificate of Title could not be subdivided without the approval of the Subdivision Authority. MOTION CARRIED 10. DEVELOPMENT PERMITS a) Permit #3804 - SE 33-21-13 W4M, Division 3 Springside Hutterian Brethren (Owner/Applicant) Construction of a farm building (barn), variance to setback from road allowance. The Manager of Planning & Development provided background information on the proposed development permit. Councillor T. Fyfe inquired that since the existing buildings were being removed, would it be possible to build the barn in the location of the old buildings so that the setback to the road allowance would not be an issue. The Applicant responded that the current buildings were part of their existing operation. Once the new barn was complete, the animals would be moved and then the other buildings could be removed. P-23/14 MOVED BY COUNCILLOR L. JUSS that the Municipal Planning Commission APPROVE Development Permit #3804, and grant approval for the construction of a farm building (barn), with a variance to the setback to the County road allowance, subject to the following conditions: This permit is being granted only to provide approval for the construction of an 114000 ft2 (10591 m2) farm building (barn), with a variance to the setback to the County road allowance, on lands legally described as SE 33-21-13 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1755-12. March 6,2014 Municipal Planning Commission Page 3 b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP #3804 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2), and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw #1755-12. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted February 6, 2014. Any changes to that plan shall require the written approval of the Development Officer. b) That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures. c) That the farm building (barn) is not used for living purposes. d) That the following setbacks on all sides are maintained for this development: Sides (north & south): 25 ft (7.6 m) Rear (east): 55 ft (17 m); variance from 100 ft (30 m) Front (west): 25 ft (7.6 m) The developer must start construction before March 20, 2015. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. MOTION CARRIED 11. POST AGENDA There were no post agenda items. 12.
