MINUTES a) July 10, 2014 MPC Minutes P 73/14 MOVED BY CLARENCE AMULUNG that the minutes of the July 10, 2014 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P 74/14 MOVED BY COUNCILLOR L. JUSS that the agenda be adopted as presented. MOTION CARRIED 6. S.D.A.B. REPORT a) Update on DP 3839 -Old Colony Mennonite Church The County Planner provided background and updated information about the S.D.A.B hearing. The County Planner informed M.P.C. that the appeal hearing was held July 16, 2014, and that S.D.A.B was required to provide a written decision within 15 days of the hearing. 7. DEVELOPMENT PERMITS a) DP 3862 - NE 35-19-14 W4M, Change in Use, Crematorium The Development Clerk provided background information on the proposed development permit. Councillor E. Unruh asked the landowners in attendance how far their properties were from the proposed site for the crematorium. L. Smith responded that they live less than a quarter mile away. T. Smith expressed ter. concerns with emissions that would be generated by the crematorium and how the crematorium would affect their lifestyle now and in the future. General concern was expressed regarding the notification process to area residents. The County Planner responded that all adjacent landowners were notified of the application in accordance with the process outlined within and, as required, by the Land Use Bylaw. The Development Clerk added that the permit was posted in the Notice of Application section of the County website. The applicant informed MPC that there are several crematoriums within the City of Calgary that are located within one square kilometer of schools, restaurants and residential areas and are not limited to industrial areas. Councillor T. Fyfe inquired what other areas they had looked at. The Applicant replied that they had investigated several locations around the County and that it was difficult to find a site that met their needs. Councillor M. Douglass commented that the notification process had been appropriate to the Land Use Bylaw. There was further discussion. The County Planner requested that a condition be added to the approval, requiring the applicant to provide a copy of the provincial license to the County. P 75/14 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning Commission APPROVE Development Permit#3862, for the use of an existing building for crematory services subject to the conditions outlined below. This permit is being granted only to provide approval for the use of an existing building for crematory services, on lands legally described as NE 35-19-14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: 1. The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw#1755-12. 2. All Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. All Alberta Building Codes and Safety Codes, where applicable. Reasons for Approval The Municipal Planning Commission has approved DP#3862 for the following reasons: a) The proposed development complies with the Municipal Development Plan. b) The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw#1755-12. Conditions of Development 1. That this development is located as shown on the site plan approved in this application and submitted June 18, 2014. Any changes to that plan shall require the written approval of the Development Officer. 2. The landowner must enter into an easement agreement with FortisAlberta. 3. That the applicant provides a copy of the Alberta Funeral License once approved. MOTION CARRIED err 8. POST AGENDA ITEMS There were no post agenda items. 9.
